About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives' Office of the Government Records Ombudsman in connection with a Request for Statements of Qualifications (RFSQ) from the State of Utah Division of Purchasing and the Governor's Office of Economic Development for German Markets Trade and PR Representation services. The RFSQ seeks statements of qualifications from companies to provide professional services representing German, Austrian, and Swiss trade and public relations interests. The contract term is five years, and vendors are explicitly instructed not to include pricing information in their qualifications submissions. The procurement will be conducted under Utah Procurement Code 63G-6a Part 15 for Design Professional Service Providers and Consultants, with the highest-ranked vendor selected for contract negotiations at compensation to be determined as fair and reasonable.
The confidentiality claim form allows vendors submitting qualifications to protect trade secrets and commercial financial information under Utah Code provisions 63G-2-305 and 63G-2-309. Claimants must provide both redacted and non-redacted versions of their proposals, with the understanding that making a confidentiality claim does not guarantee protected classification if the government receives a records request. The form requires detailed information about the company, company representative contact details, and a concise statement of reasons supporting the confidentiality claim, including the specific pages, paragraphs, and reasons for each redaction request. If fair and reasonable compensation cannot be agreed upon with the highest-ranked vendor, the state retains the right to proceed with negotiations with the next highest-ranked vendor.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
