About this file
This file is a GRAMA Business Confidentiality Claim form from the Utah State Archives, issued in connection with a Request for Statements of Qualifications (RFSQ) by the State of Utah Division of Purchasing and the Department of Health and Human Services (DHHS). The solicitation, identified as MW26-13-1, seeks a vendor to provide workforce development training specific to the Universal Prevention Curriculum Coordinator Series (UPC-C) professional education program. The contract term is five years, and vendors are instructed to submit statements of qualifications without pricing information via the U3P system or by email to mwoodward@utah.gov by the specified submission deadline. The vendor ranked highest will be selected to negotiate a contract at fair and reasonable compensation determined through subsequent negotiations; if negotiations fail with the top-ranked vendor, the state may proceed with the next highest-ranked vendor.
The confidentiality claim form allows vendors submitting proposals to protect trade secrets and commercial financial information under Utah Code 63G-2-305 by requesting confidential classification. Claimants must submit both redacted and non-redacted versions of their proposals, with the state declining to perform redactions on behalf of vendors who fail to provide a redacted copy. The form requires vendors to provide detailed company information, specify which pages and paragraphs require protection, and articulate concise reasons supporting each confidentiality claim. A confidentiality claim does not guarantee protected status if the state receives a GRAMA records request, and all submissions must comply with Utah Procurement Code 63G-6a Part 15 for Design Professional Service Providers and Consultants.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
