About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the State of Utah Division of Purchasing's request for qualifications for Fulfillment Module Package Services through the Utah Office of Tourism. The form is designed to allow vendors submitting proposals to claim protection for trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Vendors submitting qualifications for the fulfillment services contract—which involves collecting, warehousing, and scrubbing fulfillment data for Utah travel brochures from online and call center sources—may use this form to identify specific pages, paragraphs, and sections of their proposals that contain confidential information. The contract award is intended to be made under Administrative Rule R33-105 for Small Purchases of Professional Service Providers and Consultants, with a small purchase threshold of $100,000.00.

Claimants must submit both redacted and non-redacted versions of their proposals, with the entire proposal unable to be fully redacted, and must provide a concise statement of reasons supporting each confidentiality claim. The Division of Purchasing will not perform redactions on behalf of vendors who fail to submit a redacted copy. It is important to note that filing a confidentiality claim does not guarantee that information will receive protected classification if the government receives a records request under the Government Records Access and Management Act (GRAMA). Vendors are instructed not to include pricing in their submissions, as this is a request for qualifications only.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
