About this file

This is a GRAMA Business Confidentiality Claim form from the Utah State Archives, relating to procurement BB26-20 GSI Corti 2 administered by the State of Utah Division of Purchasing and the Department of Health and Human Services. The form is a template document that allows vendors submitting proposals to claim confidentiality protection for trade secrets and commercial financial information in accordance with Utah Code 63G-2-305 and 63G-2-309. The underlying procurement requests the provision of two GSI Corti DPOAE hearing screeners, with anticipated award to a single responsive and responsible vendor based on highest evaluation score. The contract term is one year, with vendors required to guarantee pricing for the full contract period.

The confidentiality claim form requires claimants to provide company information, specify which pages and paragraphs of their submission warrant protection, and provide a concise statement of reasons justifying the confidentiality claim. Critically, vendors must submit both redacted and non-redacted versions of their complete proposal, as the Division of Purchasing will not perform redactions on behalf of claimants. The claim notes that submission of a confidentiality request does not guarantee protected classification if the government receives a GRAMA records request. No specific pricing terms, funding amounts, or set-asides are detailed in this form document, as it serves solely as the confidentiality claim mechanism for the procurement process.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
