About this file

This file is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman, related to a Student Dental Services Request for Proposals (RFP) conducted by Granite School District in Utah. The form is designed for contractors or private providers to identify and protect confidential records or information, including trade secrets and commercial financial information, from public disclosure under the Government Records Access and Management Act (GRAMA). The RFP seeks a vendor to provide student dental services under a contract term of three years with two additional optional one-year renewals. The District reserves the right to award to either a single responsive and responsible vendor with the highest score or to multiple offerors if deemed in the District's best interest.

The confidentiality claim form requires submitting contractors to provide concise statements of reasons supporting their confidentiality requests, along with claimant information including company name, address, contact details, and the specific pages and paragraphs of submitted materials requiring protection. Utah Code 63G-2-305 and 63G-2-309 govern the protection of trade secrets and commercial financial information that could result in unfair competitive injury if disclosed. Claimants must note that filing a confidentiality claim does not guarantee protected classification if the government receives a public records request. The form allows for submission of both redacted public copies and confidential versions of records to accommodate transparency requirements while protecting sensitive business information.

Business Request for GRAMA Business Confidentiality Claim use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
