About this file

This file is a GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form provided by the Utah State Archives Office of the Government Records Ombudsman for use by contractors and private providers in Granite School District's Request for Proposal for a Voluntary Benefit Carrier. The RFP seeks a contractor to provide competitive group voluntary accident, critical illness, and hospital benefits to approximately 4,950 benefit-eligible employees of Granite School District. The anticipated contract award will be made to a single contractor for an initial one-year term with four one-year renewal options, extending the potential contract period to five years total.

The confidentiality claim form allows bidders to identify and protect trade secrets and commercial financial information from public disclosure under Utah Code 63G-2-305. Claimants must submit a concise written statement explaining the reasons for the confidentiality request along with the protected information. The form requires the claimant to specify which pages, paragraphs, and sections of submitted documents require protection and permits the option of providing a redacted public copy of the records. The file notes that submission of a confidentiality claim does not guarantee protected classification if the government receives a records request, and claims are evaluated according to Utah Code 63G-2-309.

Business Request for GRAMA Business Confidentiality Claim use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
