About this file

This is a Payment Terms and Conditions attachment for Davis Technical College outlining contractor payment procedures and requirements. The document establishes the framework through which contractors must submit invoices and receive compensation for services rendered to the college. Contractors are required to submit itemized invoices with supporting documentation according to established payment deadlines. All invoices for services rendered during a billing period must be submitted within twenty (20) days after the conclusion of that period. Final billings must be received within twenty (20) days of contract termination, regardless of the original billing period. For services performed by June 30th of any fiscal year, invoices must be submitted no later than July 20th of the subsequent fiscal year, with the college retaining the right to delay or deny payment for late submissions beyond this deadline.

The payment terms and conditions address overpayments and audit exceptions, granting Davis Technical College the authority to require repayment of any amounts determined to have been incorrectly paid through independent CPA audits or internal Fiscal Service Office reviews. The college may withhold subsequent payments under the subject contract or other existing contracts with the contractor until all incorrectly paid amounts have been fully recovered. These terms apply to the On Demand Window Cleaning Services contract for Davis Technical College's main campus in Kaysville, Utah, though the college does not guarantee any minimum spending amount and reserves the right to not proceed with the procurement after reviewing submitted bids.

DAVIS TECHNICAL COLLEGE PAYMENT TERMS AND CONDITIONS

1. METHOD AND SOURCE OF CONTRACTOR PAYMENT: To obtain payment for the services provided under this Contract, the Contractor shall submit to the Davis Technical College (DAVISTECH) an itemized invoice for its authorized services, together with any supporting information or documentation required for payment of supplies or services purchased for or on behalf of the DAVISTECH. The DAVISTECH shall then make payment to Contractor in accordance with established payment terms.

2. BILLING DEADLINES: The Contractor shall submit all invoices and claims for services rendered during a given billing period within twenty (20) days after the last of that billing period.

All final billings under a contract must be received within twenty (20) days of termination of the contract, regardless of the billing period. If the Contractor fails to meet these deadlines, the DAVISTECH may deny payment for such delayed billings or claims of services.

The State Fiscal Year is from July 1 through June 30. The Contractor shall submit all billings for services performed on or before June 30th of a given fiscal year no later than July 20th of the subsequent fiscal year, regardless of the termination date of the contract. The DAVISTECH may delay or deny payment for services performed in a given fiscal year if it receives the Contractor’s billing of those services later than July 20th of the subsequent fiscal year.

3. OVERPAYMENTS AND AUDIT EXCEPTIONS: If, during or after the contract period, an independent CPA audit or a Fiscal Service Office review by the DAVISTECH determines that payments made by the DAVISTECH to the Contractor were incorrectly paid or were based on incorrect information from the Contractor, the Contractor may be required to repay the incorrect payments it received. The DAVISTECH shall also have the right to withhold any or all subsequent payments under this contract or under other contracts with the Contractor until the DAVISTECH fully recoups any payments to the Contractor determined to have been made incorrectly.
