Professional Design Services IH 41 TMA Contract Document
This is a professional design services contract document between Waukesha County Department of Public Works (the Department) and a selected engineering consultant for traffic engineering services related to the I-41 Zoo Freeway project (Silver Spring Drive to Good Hope Road). The project involves developing traffic signal timing and coordination plans for ten signalized intersections in the Waukesha County area to support two traffic diversions associated with the I-41 construction project. The consultant must provide traffic data collection and modeling, conduct traffic turning movement counts, develop and implement signal timing plans for weekday AM and PM peak hours, and monitor and adjust signal timings during the Summer 2026 long-term lane closure diversion and Fall 2026 post-diversion periods. Deliverables include updated actuated traffic signal timing plans, coordination plans, technical memoranda, and engineering reports. The contract requires one virtual kick-off meeting and two virtual meetings with the Department to discuss diversion signal timing modifications and expectations. Signal timing plans are scheduled for completion by May-June 2026, with diversion monitoring continuing through Summer 2026 and Fall 2026. The contract term extends through completion and acceptance of services, with provisions allowing the Department to retain the contract for up to three years following formal written notification of final acceptance for purposes of required revisions or corrections.
Compensation is structured as a lump sum amount to be specified in the final contract for all approved traffic modeling, signal timing plans, signal timing implementation, diversion monitoring, adjustments, and required documentation. The contract provides for future amendments covering Extra Services on bases including actual costs at specified hourly rates for various staff classifications plus an approved overhead percentage, or alternatively, fixed fees negotiated between the parties. No set-asides for disadvantaged or minority-owned businesses are indicated. The Department will provide existing plans, existing signal timings, turning movement counts, and signal detail sheets. The consultant must maintain comprehensive insurance including statutory workers' compensation, commercial general liability with limits of $1,000,000 per occurrence, automobile liability of $500,000 combined single limit, umbrella coverage of $2,000,000, and professional liability/errors and omissions insurance of $500,000 per occurrence. The contract is subject to Wisconsin Department of Transportation standards, federal and state non-discrimination requirements, and Equal Employment Opportunity provisions. The consultant is responsible for accuracy of services, must correct errors and omissions without additional compensation, and must indemnify the Department against damages resulting from negligent acts, errors, or omissions.
