About this file

This is Amendment 0002 to Solicitation 030ADV25R0039, issued by the Library of Congress Contracts and Grants Directorate on February 13, 2026. The amendment updates three sections of the original solicitation: the Fair Opportunity Clause in Section I, instructions for Volume 1 Technical Proposal in Section L, and evaluation criteria for Technical Proposal in Section M. All changes are identified in red text, with all other terms and conditions remaining unchanged.

The solicitation seeks contractors to provide braille magazine transcription, pressing, embossing, collating, binding, packaging, labeling, and shipping services for the National Library Service (NLS). Offerors must submit three separate volumes: Volume 1 (Technical Proposal limited to 35 pages addressing technical approach, production capacity, and production sustainability), Volume 2 (Price Proposal based on Attachment J3), and Volume 3 (Past Performance via blind questionnaires from at least three references). The Library will evaluate proposals on technical merit (including quality assurance plans and ability to maintain two production lines), price, and past performance, with technical factors weighted more heavily than price. Nonprofits serving the blind and print-disabled may receive a 10-percent preference if prices are fair and reasonable. Proposals must be submitted electronically via email to the Contracting Officer and Contract Specialist by the deadline specified in Section A. The Library anticipates a first quarter Fiscal Year 2026 award and reserves the right to make either a single or multiple awards. All offerors must be registered in the System for Award Management (SAM) by contract award.

PART II - CONTRACT CLAUSES

SECTION I - CONTRACT CLAUSES

I.1 LC52.216-2 FAIR OPPORTUNITY (FEB 2020)

Orders will be issued by the contracting officer in writing. In accordance with FAR 16.505(b)(1) – Fair Opportunity, all contractors will be provided a fair opportunity to be selected for award of each order under this contract unless one of the FAR 16.505(b)(2) exceptions applies.

Discrete evaluation criteria may be established at the order level. Otherwise, orders will be evaluated for: (1) the technical capability of the offeror to fulfill order requirements; (2) past-performance information on prior orders under this contract or other contracts known to the agency, and recent and relevant contracts contained in the Contract Performance Assessment Reporting System (CPARS), to assess the level of risk to successful performance; (3) price as stated in the contract or submitted in response to a request for proposals; (4) capacity for large-scale braille printing efforts; and (5) the ability for NLS to have two lines of production.

If the order does not exceed the simplified acquisition threshold, the contracting officer need not contact each of the multiple awardees under the contract before selecting an order awardee if the contracting officer has information available to ensure that each awardee is provided a fair opportunity to be considered for each order. Otherwise, the contracting officer will issue a fair notice of intent to make a purchase (such as a request for proposal or request for quotation) describing the required goods or services, stating the evaluation criteria, and requesting information to support evaluation and selection of an order awardee. Unless otherwise notified in the notice of intent to make a purchase, contractors will have five business days to respond.

In all cases, the Library may conduct technical and/or price negotiations as necessary.

In all cases, the Library may in its discretion issue an order either unilaterally or bilaterally (requiring the contractor’s signature). In the event that the Library does not receive a response to a request for proposals, the Library may nevertheless issue a unilateral order if a task order award can be made based on information contained in the contract file.

The contractor shall not accept orders that exceed the “not-to-exceed” amount of the contract or that are placed after the end of the contract ordering period.

All orders are subject to the terms and conditions of this contract. In the event of a conflict between an order and this contract, the contract shall control.

[X] If checked, the provisions below apply to this order.

The Library is considering issuing additional logical follow-on task orders (related to the work performed under this order) on a sole-source basis in the interest of economy and efficiency in accordance with FAR 16.505(b)(2)(C). The contractor must demonstrate satisfactory performance during the execution of previous related task order(s) in order to be eligible for logical follow-on task orders.

SECTION L - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

L.1 LC52.215-1 PROPOSAL SUBMISSION INSTRUCTIONS - BEST VALUE TRADE-OFF (JUL

2016)

L.1 Clarifications and Questions To be considered, all questions pertaining to this solicitation must be submitted in writing to both Contracting Officer James R. Robinson (jarobinson@loc.gov) and Contract Specialist Nikolas Wellstead (nwellstead@loc.gov) no later than 5:00pm Eastern Time (ET), Tuesday July 15, 2025. Questions received after this time may not be answered. Answers to questions will be posted to Sam.gov. Offerors are responsible for checking SAM.gov to stay current of any amendments posted to the solicitation.

L.2 General Instructions to Offerors

(a) All proposals shall be submitted electronically via email to both Contracting Officer James R. Robinson (jarobinson@loc.gov) and Contract Specialist Nikolas Wellstead (nwellstead@loc.gov) no later than the response date specified in Section A of this solicitation. Offerors must comply with the submission instructions specified in this solicitation. The Library has the right, at its discretion, to determine an offer is ineligible for award if an Offeror does not comply materially with the submission instructions. Offerors submitted through any other means—including SAM.gov— will NOT be accepted.

Email Submission Instructions:

The email must include the solicitation number in the subject line. The maximum size file allowed through the Library’s email system is 20MB. If needed, the Offeror may send multiple emails, but must ensure they are clearly identified.

Offeror must not submit zipped or locked files.

(b) Offer Format: Offers must be submitted electronically in either Microsoft Office or Adobe formats. Each page must be numbered and labeled with the name of the Offeror and solicitation number. The format for all documents must be

8.5 x 11-inch pages, single- spaced, 1-inch margins, 12-point font in text.

Offeror must submit an offer package that includes two separate volumes. Each volume must include the solicitation number and the offeror’s name, mailing address, telephone number, and SAM Unique Entity Identifier (UEI) number.

L.3 Content of Offers:

Volume 1 – Technical Proposal (Technical Approach and Production Capacity)

Volume 2 – Price Proposal

Volume 3 – Past Performance

Volume 1. Technical Proposal (Limit of 35 pages, not including resumes)

A. Technical Approach. Offeror shall submit a narrative that describes how the offeror will approach the requirements of this solicitation. The narrative must show the offeror's understanding of the Library's requirement and demonstrate that the offeror can provide the services required under the contract.

More specifically, the offeror shall provide a work plan that describes in detail their work process from the initial receipt of NLS titles, processing of materials, the work-order process, workflow set-up, and how the offeror will mitigate risk to ensure quality, timely processing of work requests. The offeror shall describe, in detail, the equipment and software tools to be used in transcription, including the description of the transcription tasks, transcription process, tools, and any description of risk mitigation methods associated with providing quality, timely transcription of braille magazines. The offeror shall also describe, in detail, the equipment and software tools proposed to press/emboss braille pages, collate and bind, package, label (including the processing of subscriber address data and the printing of the address), and shipping of the braille magazines.

In addition to the information above, offeror shall submit a Quality-Assurance Plan (QAP) that demonstrates how the offeror will ensure quality standards are met in accordance with the specifications identified in Section C. The QAP shall demonstrate the offeror’s understanding of the specifications and describe how the offeror will ensure products delivered will comply with the requirements of the specifications while providing the services under the contract. The QAP shall also describe the offeror’s quality-assurance procedures. More specifically, the procedures shall include:

L.3.1 Incoming material inspection

L.3.2 In-process inspection

L.3.3 Outgoing inspection of the finished product

L.3.4 Procedures to be used to correct processes when errors are identified or when excessive product failures occur

B. Production Capacity. The offeror shall describe their current production capacity of equipment and personnel, discussing only infrastructure that is currently in place. The offeror shall note all facilities involved in production and shall provide a complete listing and production capacity of all major equipment (e.g., name, type, manufacturer, number of machines, and other data deemed essential to make an evaluation of capacity) used in each stage of production. The offeror shall state the total current production capacity and the capacity that is available to be used for this contract.

The offeror shall indicate for each production stage whether the work is done in- house, the number of persons working in that stage, and their qualifications. When personnel divide their time among several production stages, the model shall indicate this by showing the equivalent number of full-time employees for each stage (e.g., stage one: 4- ½ employees, stage two: 7 – ¼ employees, and so forth). The offeror shall indicate the work to be performed by subcontractors if appropriate. The production capacity shall clearly indicate the overall annual capacity in terms of number of average magazine titles that can be transcribed and the total number of average braille magazines copies that can be pressed/embossed and shipped. The offeror shall also include any other information that affects production capacity or reliability. In addition to this narrative, offeror shall fill out Attachment J4.

C. Production Sustainability. The offeror shall provide the Library with information regarding the minimum amount required to keep an active and stable line of production. This figure should be presented in dollars and supported with other than certified cost and pricing to support this financial information.

Volume 2. Price Proposal (no page limit)

i. Offeror shall complete Attachment J3 of this solicitation as the price proposal. Pricing shall include all services required by the Statement of Work (Section C).

Offeror must quote prices for each year of performance in order to be considered for an award. Partial pricing by an Offeror shall render the proposal unacceptable to the Library's requirement and the proposal shall not be considered for award.

Unit prices quoted shall be inclusive of all Offeror's direct costs (e.g., labor, maintenance, handling and transportation costs, other direct costs [ODCs], indirect costs, and profit). Offeror shall include all costs associated with providing the services described in, and required by, the solicitation/contract.

Note – The numbers in J3 are based upon internal estimates. These numbers are not a guarantee of work. J3 shall be used to evaluate total evaluated price for the purposes of this competition only. The numbers in J3 are based upon a potential single-award IDIQ. A multiple-award IDIQ is, however, possible. As a result, quantities may be different.

ii) SF1449 – Offeror must provide a signed copy of the SF1449.

iii) Submission of amendments to the solicitation – Offeror shall acknowledge amendments to the solicitation to confirm Offeror has read and agrees to comply with the terms and conditions of the solicitation. Amendments to the solicitation must be signed, dated, and submitted as part of the price proposal.

iv) Non-Profit Status – Offeror is not required to be a nonprofit. An offeror who wishes to be considered for the nonprofit price preference must provide proof of their nonprofit status and submit as part of their price proposal.

Non-Profit Preference Eligibility Policy – NLS follows the mandate of Public Law 89-522 for the purchase of books, either in raised characters or in sound-reproduction recordings, by giving preference to nonprofit institutions whose activities are primarily concerned with the blind and other print-disabled persons where offers submitted by such institutions are determined to be fair and reasonable. To fulfill the intent of this mandate, and in order to receive this preference, a contractor must perform a substantial portion of the work that is represented by the cost of producing the described items, or by making a significant contribution to the manufacture or production of the end item. Definitions for these criteria are as follows:

L.3.5 A substantial portion of the work means a minimum (fifty percent or more) of braille transcription or pressing or embossing activities, to be determined by one or more of the following: (1) cost (not including cost of materials), (2) labor hours, or (3) number of titles.

L.3.6 A significant contribution means either (1) the transcription or (2) the pressing, embossing, packaging, and shipping activities.

Volume 3. Past Performance.

Offeror shall send the blind past-performance questionnaire (PPQ) identified in Section J (Attachment J5) to its Government and or commercial customers for projects of similar size and scope that have been performed within three

(3) years of the solicitation release date. Offeror shall ensure that the Government receives at least three (3) completed questionnaires. Forms submitted directly to the Government by the offeror will not satisfy the requirement for blind past-performance information and will not be evaluated. Questionnaires shall be returned directly to both Contracting Officer James R. Robinson (jarobinson@loc.gov) and Contract Specialist Nikolas Wellstead (nwellstead@loc.gov) by the solicitation closing date and time. References may be for the prime or subcontractors. At least two (2), however, shall concern the relevant past performance of the prime.

Forms that are received after the response deadline, or that are submitted directly by offeror to the Library, will not satisfy the requirement for blind-customer information and will not be accepted. References must not copy offeror or offeror’s agents on the past-performance questionnaire email, as the requirement is for blind-customer information.

The Library has no responsibility to correct misinformation, or clarify ambiguities, in the past-performance questionnaires.

SECTION M - EVALUATION FACTORS FOR AWARD

M.1 LC52.215-2 EVALUATION - BEST VALUE TRADE-OFF (FEB 2020)

This is a best-value-trade-off (BVTO) competition in accordance with FAR Parts 12 and 15.

The Library will award the contract(s) resulting from this solicitation to the responsible offeror(s) that provide the best value to the Library. The Library intends to evaluate the proposals and award the contract(s) without discussions with offerors, except clarifications as described in FAR 15.306(a). Therefore, offeror's initial proposal should contain offeror's best terms. The Library reserves the right to conduct discussions if the Contracting Officer determines it is necessary. If the Contracting Officer determines the number of proposals that would otherwise be in the competitive range exceeds the number at which efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit efficient competition among the highly rated proposals.

Best value will be determined through the evaluation of the following factors:

Technical Proposal (Technical Approach and Production Capacity)

Price Proposal

Past Performance

Factors are in descending order of importance. All other factors, when combined, are more important than price.

M.1 Technical Proposal

M.1.1 Technical Approach. The Library will evaluate the offeror's technical approach to assess the degree to which the offeror demonstrates an understanding of the work and feasibility of completing each of the requirements in Section C of this solicitation. The Library will evaluate the offeror's quality-assurance plan (QAP) to determine its effectiveness in facilitating the successful performance of the contract.

M.1.2 Production Capacity. The Library will evaluate the offeror's current production capacity to include equipment and personnel available to perform the services identified in Section C of the solicitation to include the extent that one offeror can deliver all of the Braille Magazine Titles identified in Attachment J1.

M.1.3 Production Sustainability. The Library shall evaluate the details in the Production Sustainability information presented by the company. The Library will use this information to assist in its award determination regarding maintaining 2 lines of production.

M.2 Price Proposal

Price. For evaluation purposes only, the Library will multiply the offeror's proposed unit prices by the Library's estimated quantities in Attachments J3 and add the total price for each out year to establish the total evaluated price.

Additionally, for evaluation purposes only, the Library will reduce the proposed price of an offer qualifying for the Non- Profit Preference described in L.2 (c) Volume 2 (iv) by 10% to establish that offeror’s total evaluated price.

In accordance with 2 U.S.C. § 135a, the Library reserves the right to give preference to nonprofit-making institutions or agencies whose activities are primarily concerned with the blind and with other print-disabled persons, in all cases where the price or bids submitted by such institutions or agencies are determined to be fair and reasonable under all the circumstances and needs involved (for these purposes fair and reasonable means no greater than 10 percent higher than prices quoted by commercial sources).

Note – The numbers in Attachment J3 are based upon internal estimates. These numbers are not a guarantee of work.

J3 shall be used to evaluate total evaluated price for the purposes of this competition only. As a result, quantities may be different.

M.2.1 Evaluation Methodology. The Library shall award one firm-fixed-price with economic price adjustment (FFP-EPA) IDIQ contract, or multiple FFP-EPA IDIQ contracts, to the offeror/offerors that represents the best value based on the evaluation factors above. If discussions are required, the Library reserves the right to enter into discussions with only the most-qualified offerors or those most likely to be able to fulfill the requirements.

M.2.2 General. The award of any resultant contract will be based upon a review and assessment of the offeror’s proposal against the Library’s evaluation factors. After an initial evaluation, the Library reserves the right to enter into discussions only with those most qualified by determining a competitive range. If a competitive range is established, those who do not qualify will be notified and will not be qualified for an award. The Library reserves the right to not establish a competitive range and also reserves the right to award without discussions.

Note – The Library may make a single award if one offeror has the capacity to fulfill all of the requirements of Section C, but the Library reserves the right to award multiple contracts to ensure all requirements are fulfilled.

M.2.3 Funding. This requirement is being competed in Fiscal Year 2025. The performance and award, however, is not required until Fiscal Year 2026 (The Library anticipates a first quarter award in FY26). As a result, funding is not currently available to fund this contract at the time of solicitation. By responding to this solicitation, the offeror acknowledges this.

M.2.4 System for Award Management. In order to receive an award from the Library of Congress, the offeror must be registered in the System for Award Management (SAM). If the offeror is not registered in SAM at the time of offer submission, per FAR 4.1102(a), the offeror may not be eligible to receive a contract from the Government—unless other methods can be employed to determine responsibility. Regardless, your business must be registered in SAM by the time of contract award.

Registration can be done here: https://www.sam.gov/. SAM registration is free.

If you require assistance with registering or renewing your business in SAM, you can obtain assistance at the Federal Service Desk, located here: https://www.fsd.gov/gsafsd_sp.

M.3 Past Performance

Past Performance. Past Performance will be evaluated based on customer feedback from three (3) completed projects within the past three (3) years as documented by blind past-performance questionnaire (PPQ) (Attachment J5).

Feedback will be evaluated based on the relevancy of the projects to the Statement of Work (Section C) and how well the offeror performed thereunder. The Library will evaluate relevant past-performance information to assess the degree of risk to successfully perform the work described in this solicitation.

Note: Offerors are advised that the Government is not limited to the past-performance questionnaires (PPQs) received and reserves the right to obtain additional past-performance information as necessary, including, but not limited to, that contained in the Contractor Performance Assessment Reporting System (CPARS). In the case of an offeror without a record of relevant past performance, or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance.
