C.1 OVERVIEW / BACKGROUND
The Library creates and receives sensitive materials in the course of business in all formats including: paper, mixed electronic media including: hard drives, Oracle, linear tape-open (LTO), Enterprise tape media and disk, CDs, diskettes, moving image and audiovisual material including motion picture film, magnetic and digital media in a wide range of formats and specialty items submitted for copyright. The Library of Congress has several divisions of the Library that have a need for a contractor to provide services for the secure destruction and disposal of these materials when they have been decommissioned or have become eligible for destruction and their retention is no longer required. The offices of OCOO, OCIO and its divisions have shredding and destruction requirements as well as other areas of the Library listed below.
The Office of Copyright Records (OCR) under The U.S. Copyright Office, "USCO" or "Office," is responsible for preserving, maintaining, and servicing copyright-related records in physical and digital formats. The USCO receives sensitive deposit materials in the course of business in all formats, including jewelry, books, magazines, statues, ceramic figurines, sheet music, manuscripts, maps, architectural drawings, carpet and wallpaper samples, fabric, photographs, film, posters, and audiovisual materials. The Office of Copyright Records receives reviews, executes, and maintains records and deposits for copyright, including records that establish and transfer copyright ownership, included in the world's largest database of records of copyright ownership. The
Records Management Division is responsible for the management, storage, and retrieval of paper records and physical deposits (i.e., a submitted artifact or facsimile of copyrightable material). In addition, certain records created or received by the Copyright Office are subject to specific records provisions found in the Copyright Act.
See 17 U.S.C. 704(d) and 705.
Records Management (OCIO/QPM/RM) is the office responsible for overseeing the destruction of all Library records in accordance with Library policy LCR 5-810 and federal regulations. They require secure destruction for official Library records including paper documents that may contain a range of sensitive and personally identifiable information, as well as mixed electronic media including CDs, DVDs, Zip drives, VHS tapes, hard drives, and chip enabled IDs. Pursuant to 44 U.S.C. 2901, the Library records management program is subject to the Federal
Records Act (44 U.S.C. ch. 31) and the Federal Records Disposal Act (44 U.S.C. ch. 33). Pursuant to 44 U.S.C. 3102, the Library records management program is subject to Federal regulations issued by the National Archives and http://uscode.house.gov/view.xhtml?req=(title%3A17%20section%3A704%20edition%3Aprelim)%20OR%20(granuleid%3AUSC-prelim-title17-section704)&f=treesort&edition=prelim&num=0&jumpTo=true http://uscode.house.gov/view.xhtml?hl=false&edition=prelim&req=granuleid%3AUSC-prelim-title17-section705&f=treesort&num=0&saved=%7CKHRpdGxlOjE3IHNlY3Rpb246NzA0IGVkaXRpb246cHJlbGltKSBPUiAoZ3JhbnVsZWlkOlVTQy1wcmVsaW0tdGl0bGUxNy1zZWN0aW9uNzA0KQ%3D%3D%7CdHJlZXNvcnQ%3D%7C%7C0%7Cfalse%7Cprelim http://uscode.house.gov/view.xhtml?req=(title%3A44%20%20section%3A2901%20edition%3Aprelim)%20OR%20(granuleid%3AUSC-prelim-title44%20-section2901)&f=treesort&edition=prelim&num=0&jumpTo=true http://uscode.house.gov/view.xhtml?path=/prelim%40title44/chapter31&edition=prelim http://uscode.house.gov/view.xhtml?path=/prelim%40title44/chapter33&edition=prelim http://uscode.house.gov/view.xhtml?req=(title%3A44%20%20section%3A3102%20edition%3Aprelim)%20OR%20(granuleid%3AUSC-prelim-title44%20-section3102)&f=treesort&edition=prelim&num=0&jumpTo=true
Records Administration (NARA) in 36 C.F.R. parts 1220-1239 and by the General Services Administration (GSA) in 41 C.F.R. part 102-193. All records are shredded or destroyed in accordance with NARA and federal regulations.
Additionally, OCIO / ITSO division has traditionally shredded and destroyed hard drives, enterprise tape (LTO, Oracle) at the Madison building and the Alternate Computing Facility (ACF) located in Manassas, VA. The Human
Capital Directorate (COO/HCD) requires secure destruction of sensitive non-record materials which may include sensitive and personally identifiable information (PII). Materials requiring destruction will vary and will include paper and books, as well as mixed electronic media such as computer diskettes, CDs, DVDs, tapes, and hard drives.
Paper material may contain metal prongs, staples, paper clips, or binder clips. Also, the COO/ISS Divisions of
Logistics, NLS also have a need for these services. CRS may also have a need for the same type of services and may utilize this contract.
The National Audio-Visual Conservation Center (NAVCC) located in Culpeper, VA consists of general office space and support spaces, laboratories, collections cold storage bays and vaults. The Moving Image Section utilizes and maintains a wide variety of moving image and audiovisual material which includes: magnetic videotape and soundtracks, media, digital media, and motion picture film from the collections, and requires contract support to dispose of these materials when no longer needed.
The Library currently has several individual contracts for the secure shredding and destruction of documents, and electronic media. This effort includes a broader scope of requirements than the contracts currently awarded and will allow for more divisions to utilize it.
