STATEMENT OF WORK FOR

STAFFING THE GLACIER NATIONAL PARK

VISTOR TRANSPORATION SERVICE

BACKGROUND:

Glacier National Park began the Park shuttle system in 2007 as the major rehabilitation of the Going-to-the-Sun Road (GTSR) got underway. It has operated on the GTSR corridor for 13 years under a cooperative agreement with Flathead County and one-year self-delivered. While the park envisioned a transportation system in Glacier when a major transportation study and plan was done in the 1990s, the catalyst for this system was the road construction. The intent was to reduce traffic congestion in the construction zones. This happened to a small extent but not to the levels envisioned when the system was stood up.

OBJECTIVE:

The objective of this requirement is to obtain Bus Drivers and Staff that will provide safe, professional, courteous, informative (non-interpretive), and timely service to operate the Visitor Transportation System (VTS) with the goal to improving visitor service from previous years.

However, timely service shall not come at the expense of safety, professionalism, and courtesy.

GUIDING PRINCIPLES:

The Glacier National Park VTS operates under the following guiding principles. The Park’s VTS will always keep simple over efficient in operation decisions be visitor friendly in all aspects of the system aid in reducing congestion on the GTSR keep the same route configuration for the east and west sides of the park

SCOPE OF WORK:

01. Transit Service:

The Contractor shall provide all VTS bus drivers and staff necessary to provide the VTS as defined in this Statement of Work, and in accordance with the Federal Motor Carrier Safety Administration, Department of Transportation, Title 49, CFR Part383, controlled substances and alcohol use and testing, Medical Advisory Criteria for Evaluation under 49 CFR Part391.41, Department of Public Instruction Office Services, National Fire Protection Agency10 (NFPA 10), and the state of Montana Department of Transportation.

02. Transportation System Configuration:

The Park has two main VTS start points at each end of the GTSR known as the Apgar Visitor Center on the west and the St. Mary Visitor Center on the east. These serve as the VTS hubs for the Park with routes emanating from each along the GTSR. There are three Transfer Stops where drivers disembark passengers, allow them to stay on board, board another bus, or take advantage of the attractions offered at the transfer stop.

Flathead Valley’s Mountain Climber transit system has a commuter shuttle which will provide service from the communities on the west side of the park to just inside the West Entrance. This commuter service will link to the VTS inside the park where riders will transfer between the Mountain Climber shuttle and the VTS shuttle.

Schedules for the routes of the VTS are developed by the National Park Service (NPS) with the emphasis on providing reliable route starts and maintaining headways throughout the day and not on meeting specific times along the routes. Many factors affect schedules, including traffic congestion, wildlife, motor vehicle accidents, and construction, which are beyond the control of the Drivers.

Maintenance of the VTS fleet is handled through the park’s Auto Shops. The park’s mechanics will make all determinations of service and repairs required. If the need for manufacturer maintenance is required, the park’s mechanics will coordinate with the appropriate dealership for those needs. All decisions by the park mechanics concerning the mechanical and safety disposition of the buses are final.

Buses are housed in two areas of the park. There is a dedicated parking lot in West Glacier adjacent to the Headquarters building and next to the bus wash facility. In St. Mary, the buses are housed in an area referred to as the ballfield. These parking areas are where the drivers park their personal cars report at the beginning of their shifts to conduct pre-trip inspections. Drivers then proceed to the Transit Center in their area of the park to check in with Dispatch and the Deputy Leads.

Government Furnished Equipment & Facilities:

The government furnishes the following equipment for this contract:

Buses Bicycle Trailers Bus Wash Transit Center Offices Computers and peripherals including but not limited to monitors, speakers, and pointers Shirts and hats provided at government expense; coordinated by the contractor’s Transit

Lead with the COR Electrostatic Sprayer and disinfecting chemical All required safety equipment on the buses including, but not limited to, stop signs and reflective vests

Cell phones to the Transit Lead and Deputy Lead positions

03. Period of Performance:

Peak Season: The VTS operates seven days per week during the period of highest Park visitation, i.e. July 1 to Labor Day, considered peak season. There are two options that will be priced and considered as funds are available, an early season hiker/biker shuttle, and an extension to the season after Labor Day.

Hiker/Biker: In the spring the VTS operates the Hiker/Biker Shuttle from the Saturday of Mother’s Day weekend until the GTSR opens to the public for the season or July 1, whichever comes first. Typically, the plowing of the GTSR concludes sometime in late June allowing the park to open the road to the public. This shuttle operates from the Apgar Visitor Center to the Avalanche Transfer Stop on weekends only with 3 to 5 buses depending on demand. The Park owns six Huckwagon bicycle trailers that hold 16 plus bicycles. Each bus on this route pulls one of these bicycle trailers.

Fall Shoulder Season: After Labor Day the contractor shall provide staff to run a limited VTS on a day-by-day basis for up to an additional two weeks into September. Refer to the Route, Schedule and Period of Performance Changes section below for additional information.

Specific dates for each operating season will be provided with the individual task order for the year.

Mother’s Day is observed the second Sunday of May Labor Day is observed first Monday in September

04. Season Schedules:

For the peak season operation, the general VTS runs from 7:00 AM to 7:00 PM, 7-days per week for the entire peak season. The day starts with the Hiker Express Shuttle at 7:00 AM each day from the Apgar and 8:00 AM from the St. Mary Visitor Center. The regular VTS starts each day at 9:00 AM. The last bus leaves Logan Pass Visitor Center at 7:00 PM. The “Last Bus” time is aggressively communicated to passengers to plan their day for departure before 7:00 PM. Buses will be deadhead dispatched as needed at the end of the day to clear Logan Pass and the stops along the GTSR of visitors who are depending upon the VTS.

05. VTS Routes:

See Attachment 03 for a map of the Transit routes.

a) Lake McDonald Valley Route

The Lake McDonald Valley Route operates from the Apgar Visitor Center, the west transit hub, to the Avalanche Transfer Stop. This route utilizes the larger buses. Once begun each day this route loops multiple times per day with 30-minute headways. Two stops are made including Sprague Creek Campground, and Lake McDonald Lodge. The route begins at 9:00 AM with the last bus leaving Avalanche at approximately 8:30 PM.

b) Hiker Express and West Alpine Routes

The Hiker Express and West Alpine Routes are combined. This route utilizes the Sprinter style buses. There is a “commuter” transfer point just inside the West Entrance Station where Mountain Climber will bring visitors. The Hiker Express operates each morning from this transfer point and from Apgar Visitor Center to Logan Pass Visitor Center and then converts to the West Alpine Route. On the Hiker Express run, the only intermediate stop is made at the Loop. The route begins at 7:00 AM with 15-minute headways between buses. After dropping hikers off at Logan Pass it heads to the Avalanche Transfer Stop and begins the West Alpine Route, looping between Avalanche and Logan Pass for the balance of the day with 10-minute headways. The advertised last bus leaving Logan Pass each day is at 7:00 PM. Toward the end of the day buses are deadheaded to Logan Pass to help clear the Pass of aggregate passengers.

c) St. Mary Lake Valley Route

The St. Mary Lake Valley Route operates from the St. Mary Visitor Center, the east transit hub, to the Sun Point Transfer Stop. Like the Lake McDonald Valley Route this route utilizes the larger buses. This route loops multiple times per day with 30-minute headways. One stop is made at the Rising Sun Boat Dock. This route begins at 9:00 AM with the last bus leaving Sun Point at between 7:30 PM and 8:00 PM.

d) Hiker Express and East Alpine Routes

The Hiker Express and East Alpine Routes are combined. This route utilizes the Sprinter style buses. The Hiker Express operates each morning from St. Mary Visitor Center to Logan Pass Visitor Center and then converts to the East Alpine Route. On the Hiker Express run, two intermediate stops are made at the Gunsight Trailhead and Siyeh Bend.

The route begins at 8:00 AM with 15-minute headways between buses. After dropping hikers off at Logan Pass it heads to the Sun Point Transfer Stop and begins the East Alpine Route, looping between Sun Point and Logan Pass for the balance of the day with 15-minute headways. The advertised last bus leaving Logan Pass each day is at 7:00 PM.

Toward the end of the day buses are deadheaded to Logan Pass to help clear the pass of aggregate passengers.

06. Specific Tasks:

The Contractor shall provide adequate staffing in each of the categories discussed below:

a) Provide one Transit Lead position overseeing the Visitor Transportation System (VTS) in Glacier National Park. This position shall be available to start work two weeks before Mother’s Day weekend. This position will operate primarily out of the Apgar Visitor Center Transit Office and frequently travel to the St. Mary Transit Office using an NPS provided vehicle. This position is responsible as a minimum for:

a. Serving as the primary on-site representative for the NPS Contracting Officer’s Representative (COR) to act on matters pertaining to the performance of all services required for the VTS.

b. Setting up offices and operational requirements for the VTS pre-season.

c. Shuttering offices and systems at the end of the VTS season.

d. Supervision of all staff hired for the VTS by this contract.

e. With the COR, developing and managing the daily schedule of buses and routes.

f. Training of all personnel supporting the VTS throughout the transit season.

g. Resolving visitor issues with the COR to ensure minimal impacts to visitors using the VTS.

h. Overseeing the maintenance of the transit vehicles ensuring the necessary checks and services are made when they are due and coordinating repairs with the Park Auto Shops.

i. The safety of employees and visitors engaged with operating or using the VTS.

j. Completion and submittal of required reports as established by the COR.

k. Reporting damage to government property to the COR within 6-work hours after such occurrence.

l. Reporting all incidents or accidents involving visitors to Law Enforcement immediately.

m. Reporting to and communicating with the COR.

n. Reporting any media contacts with the COR.

o. Coordinate the Orientation Training with the COR for dates, location, and presented information.

b) 5.2 Provide two Deputy Lead positions supporting the Transit Lead in overseeing the VTS. The west side Lead will start on the Saturday of Mother’s Day weekend and the east side Lead will start two weeks before July 1st. These two positions with the Transit Lead provide 7-day per week on site management coverage (see the Shift Analysis tab in Attachment 02). One position will operate from the St. Mary Visitor Center Transit Office and the other position will operate from the Apgar Visitor Center Transit Office.

When the Transit Lead is off shift one of the Deputy Leads will be designated as the acting Transit Lead. Close coordination between the east and west Deputy Leads is critical during all hours of operation and essential when the Transit Lead is off shift.

There is joint responsibility for Logan Pass Visitor Center.

a. The Deputy Lead positions will be responsible for:

b. Acting for the Transit Lead on their respective sides of the GTSR.

c. Performing the tasks in paragraphs d, f, g, i, k, l, and m from the Transit Lead responsibilities.

d. Shift supervision in their Transit Hub and for their routes.

e. Overseeing the bus schedules on their respective sides of the park ensuring buses start their routes on time.

f. Overall route operations during the day working to keep the headways somewhat consistent on the individual routes.

g. Maintaining awareness through the day along their respective routes of visitor wait times at the two Transit Hubs and the three Transfer Stops and working solutions to keep wait times below 30-minutes.

h. Administering the Park Ticket System at each of the Transit Hubs it one is used during that VTS season.

i. Any contact by the media must be immediately reported to the COR. Leads are not authorized to engage with the media.

c) Provide six Dispatcher positions distributed three per side of the Park. These positions shall be available to start work on the scheduled training days then full-time work on July 1st. The Dispatchers will provide 7-day per week coverage from 7:00 AM to 8:00 PM (see the Shift Analysis tab in Attachment 02). Dispatchers are responsible for the following:

a. Operate the radio system in communicating with drivers and NPS personnel.

b. The Dispatcher shall maintain a summary log of all radio traffic.

c. The Dispatcher shall fill out the NPS provided “Lost and Found” form for all lost articles found. Articles must be delivered to the NPS Lost and Found Coordinator no later than 11:00 AM for articles lost on the previous day.

d. The Dispatcher shall be responsible for communicating with the NPS Dispatch Office via telephone for any emergencies; damage to any vehicle, personal property, or government property , serious accident; personal injury requiring medical attention (e.g., sick passenger); or an event requiring law enforcement intervention (e.g., argument with a passenger, physical violence on a bus).

d) Provide a minimum of 64 transit vehicle drivers with CDL and passenger endorsement to drive government furnished buses. These positions shall be available to attend scheduled training days in June and start work on July 1st. These drivers shall meet the following:

a. Each transit vehicle operator engaged in the provision of the NPS VTS shall be at least 21 years of age and shall meet all minimum state requirements to receive and possess before the operating season, a valid Montana Commercial Driver’s License Class “B” with a passenger endorsement.

b. Any of the above noted license(s) shall be in possession of the drivers when operating a vehicle under this contract and shall be available for inspection by the CO on request.

c. Each transit vehicle operator must have a current U.S. DOT medical card in their possession when operating a vehicle in the VTS.

d. Transit vehicle operators shall meet the minimum physical standards as described by the Federal Motor Carrier Safety Regulations, 49 CFR.

e. Transit vehicle operators shall have a high school or equivalency diploma and have the ability to read, write, speak, and understand the English language.

f. Transit vehicle operators shall be able to announce stops and provide basic, accurate, information to questions from visitors in a courteous manner.

g. All transit vehicle operators must show a positive attitude toward passengers, other road users, and the general public at all times including during stressful situations.

h. All transit vehicle operators shall present a professional, groomed, and neat appearance that projects a favorable image to the public.

i. The NPS reserves the right to have the Contractor remove any transit vehicle operator from contact with the park visitor if, in the opinion of the NPS, he/she is not a safe driver or for any other reasonable cause.

j. Each transit vehicle operator shall inspect their transit vehicle daily as required by the Federal Motor Carrier Safety Regulations. Records of each inspection shall be retained for the duration of the contract then turned over to the NPS. All safety defects found shall be corrected before the vehicle resumes the VTS.

k. There are to be no media conducted interviews on board the transit vehicles. If this should occur, the transit vehicle operator shall notify their supervisor who will contact the Park and request further instructions.

l. It is the responsibility of the transit vehicle operator to ensure orderly conduct of passengers and perform all duties necessary to promote the welfare and safety of all passengers.

m. Tips may not be solicited or accepted by transit vehicle operators for any services provided under this contract. If money is found on the bus it is to be turned over to the shift supervisor.

n. Each transit vehicle operator shall contact the Contractor’s dispatch personnel under the following conditions: 1) reporting emergencies, accidents, or incidents (regardless of how minor), 2) reporting all lost items, 3) when excessive passenger load may require the service of additional buses, or 4) when there is a mechanical problem with the transit vehicle.

e) Provide a minimum of four Passenger Loading Assistants (PLA) to float as assigned in the Park either on the east or west sides and provide visitor control at any one of the hubs or Transfer Stops. These positions shall be available to attend training days in June and start work on July 1st. These positions are responsible for:

a. The Passenger Loading Assistants will be on call during high visitor use periods of the operating season, including weekends and holidays, to manage seated capacity and line wait queues at the transit hubs or one of the three select transfer stops. Assigned locations will be determined by the Transit Lead and/or Deputy Leads in consultation with the COR.

b. Passenger loading assistants shall have the ability to read, write, speak, and understand the English language. High school or college interns are permitted at the minimum legal age for work in Montana.

c. Passenger loading assistants shall be able to provide basic, accurate, information to questions from visitors in a courteous manner.

d. All passenger loading assistants must show a positive attitude toward passengers, and the general public at all times including during stressful situations.

e. All Passenger loading assistants shall present a professional, groomed, and neat appearance that projects a favorable image to the public.

f) Provide Dispatchers, Drivers, and PLAs to be on call as needed to fill in positions on a temporary basis.

07. Other Performance Requirements:

a) Orientation Training Scheduled in the second full week of June each year, all staff of the VTS hired under this contract will be in a paid status and report for up to three days of orientation training to Glacier National Park, orientation to the Park’s VTS, specific training on driving the transit vehicles, and conduct driver training on the GTSR.

The Orientation Training dates and location will be determined annually when the Transit Lead starts. Actual driving on the GTSR may be put off until later in June if spring opening operations prevents access to the GTSR alpine section of the road. Normally this is from the middle to late June.

b) Hiring

As part of the Contractor’s employee application process the following shall be required:

a. Each applicant shall submit a copy of their motor vehicle record (MVR) to the

Contractor.

b. The Contractor shall have a criminal history investigation (National Crime

Information Center) completed for each applicant before employment. This investigation shall include checks for wanted or convicted felon status, as well as current MVR information.

c. The Contractor shall reject any applicant whose record contains more than five violation points within the last two years or whose record contains a conviction for driving under the influence (DUI), driving while impaired (DWI), and/or implied consent refusal within the last five years regardless of the type of vehicle that was being driven.

d. The Contractor shall reject any applicant who is a wanted or convicted felon.

e. The Contractor shall ensure that employees have current and valid licensing and professional certifications, as applicable, before starting work.

c) Conduct of Contractor Employees The NPS is regulated by Title 36 of the Code of Federal Regulations – Parks, Forests, and Public Property, which also applies to Contractor’s employees.

Contractor agrees to assume liability for and to indemnify and hold harmless the NPS, managers, officers, employees, agents, and attorneys from and against any and all liabilities, losses, damages costs, payments, and expenses of every kind and nature (including attorney’s fees and disbursements) as a result of claims, demands, actions, suits, proceedings, judgments, or settlements from claims arising out of, or alleged to have arisen out of, or in any way relating to, or alleged to be relating to, the negligence of the Contractor or their employees, or the execution, performance, nonperformance, or enforcement of this contract including the enforcement of this indemnification provision, upon notice from NPS of any such liability or claim that NPS believes to be covered by this section. The Contractor shall defend and accept NPS tender of defense of all suits brought upon all such liabilities or claims and shall pay all costs and expenses incidental thereto, including attorney’s fees incurred by the NPS, but the NPS shall have the right, at its option, to participate in the defense of any suit, without relieving the Contractor of any of his/her/their obligations hereunder. The obligations contained in this section shall survive termination of this contract and shall not be limited by the amount of any insurance required to be obtained or maintained under this contract.

a. The Contractor shall ensure that all employees show a positive attitude toward passengers, other road users, and the general public.

b. Contractor personnel shall present a neat appearance.

c. All employees must be able to speak, read, write, and understand English.

d. The Contractor shall ensure that all employees comply with all applicable Park, NPS, state, and federal laws, rules and regulations.

e. The Contractor shall ensure that employees do not smoke outside of designated smoking areas or within view of the public.

f. The Contractor shall ensure that employees do not smoke inside or within 25 feet of the transit vehicle maintenance facility.

g. The Contractor shall prohibit their employees from using their mobile phone while driving. Phones may be used in case of an emergency or conducting the VTS business after the vehicle they are driving has safely come to a complete stop and not obstructing traffic.

h. The Contractor shall terminate any employee who is out of compliance with the violations stated in 5.2.

i. The CO may require, in writing, that the Contractor remove any employee that the CO deems incompetent, careless, or otherwise objectionable.

d) The Contractor shall track the number of complaints a driver may receive and provide upon request that information to the COR.

e) Contractor Interfaces The individuals hired by the Contractor will be required as part of the performance of the VTS to work with other contractors hired by the NPS. Such other Contractors shall not direct this Contractor in any manner. Also, this Contractor shall not direct the work of other Contractors in any manner.

f) Disclosure of Information

Information made available to the contractor by the NPS for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer (CO).

g) Hours of Work

Contractor personnel are expected to conform to the VTS schedule developed by the NPS for transit operations. These hours will vary to conform to the various routes along the

GTSR. The VTS will operate from 7:00 AM to 7:00 PM, seven days per week. Lunch period is ½ hour for all VTS personnel; however, there is no set time for when it is taken.

Duty days include all Federal holidays between Mother’s day weekend and late August and September and hours are subject to vary slightly based on the schedule and as needed to deliver a safe and efficient VTS.

Specific dates for each operating season will be provided with the individual task order for the year.

h) Productive Direct Labor Hours

The contractor can only charge the Government for “Productive Direct Labor Hours”.

“Productive Direct Labor Hours” are defined as those hours expended by the Contractor personnel in performing work under this effort. This does not include on call, sick leave, vacation, Government or contractor holidays, jury duty, military leave, or any other kind of administrative leave such as acts of God (i.e. hurricanes, snow storms, tornadoes, etc.), or any other unexpected government closures.

i) Payment for Unauthorized Work

No payments will be made for any unauthorized supplies and/or services or for any unauthorized changes to the work specified herein. This includes any services performed by the Contractor of their own volition or at the request of an individual other than a duly appointed Contracting Officer. Only a duly appointed Contracting Officer is authorized to change the specifications, terms, and conditions under this effort.

j) Contractor Personnel The Contractor shall be responsible for providing qualified personnel identified in Section 4. The Contractor's responsibilities shall include all activities necessary to ensure the personnel are hired and arrive in the Park with the necessary licenses, background checks, endorsements, and qualifications to perform the work of this effort.

k) Contractor Appearance

Contractor provided personnel shall present a neat appearance. Employees will wear contract provided shirts and hats to be worn with khaki pants and/or shorts. A name bar will be provided to each driver.

When the Contractor’s personnel are in the Park and working in other situations where their status is not obvious to third parties, they must identify themselves as Visitor Transportation System employees and avoid creating the impression that they are government employees.

l) Physical Security

The contractor shall be responsible for safeguarding all government property provided for contractor use. At the end of normal duty hours and/or after normal duty hours, all government facilities, equipment and materials must be returned and/or secured.

m) Key Controls

The contractor shall ensure all keys issued to personnel hired for this VTS by the government are not lost or misplaced and are not used by unauthorized persons or for unauthorized purposes. The contractor’s personnel shall not duplicate any keys issued by the government. The contractor shall immediately report to the COR any occurrences of lost keys.

The contractor must prohibit the use of keys issued by the government by any persons other than the contractor's employees. Opening of locked areas by contractor employees to permit entrance of persons other than contractor employees engaged in performance of work requirements in those areas is prohibited.

n) Special Event Services

It is anticipated that the NPS will request additional buses for NPS administrative chartered tours (within the current fleet configuration). This service may occur during programmed VTS operations and may be on the principal transit route or an alternate route.

a. The rate charged for NPS administrative chartered service shall be equivalent to the regular transit vehicle driver’s hourly rate.

b. Chartered services will be added to the monthly invoice.

o) Emergency Situations In the event of emergency situations such as dangerous weather, rock or debris fall, wildland fire, accident, or incident on the GTSR, transit vehicle drivers with the concurrence of the Transit Lead, may modify routes and schedules as they deem necessary during the period of the emergency. All situations requiring modification of routes and schedules must be immediately relayed in order of priority within 30 minutes to:

a. Park dispatch at (406) 888-7801.

b. Contracting Officer’s Representative: Office phone (406) 888-5817; Cell (406)

249-5254

c. Chief Ranger: Office phone (406) 888-7828 or (406) 888-7849.

The CO, Superintendent, or Chief Ranger may modify routes and schedules as they deem necessary during periods of emergency (e.g. transporting large numbers of fire fighters, temporary road closures, etc.).

08. Places of Performance:

Services will be provided on the Going-to-the-Sun Road at the transit assembly areas in West Glacier and St. Mary, transit hubs (Apgar Visitor Center and St. Mary Visitor Center), transfer stops (Avalanche, Logan Pass Visitor Center, and Sun Point), and the other stops along the GTSR and at the bus parking areas and Auto Shops.

09. Deliverables Schedule:

In fulfillment of this effort, the Contractor shall provide the following deliverables. All deliverables shall be submitted to the COR, unless otherwise agreed upon.

Unless otherwise specified, the Government will have a maximum of ten (10) working days from the day the draft deliverable is received to review the document, provide comments back to the contractor, approve or disapprove the deliverable(s). The contractor will also have a maximum of ten (10) working days from the day comments are received to incorporate all changes and submit the final deliverable to the Government. All days identified below are intended to be workdays unless otherwise specified.

a) Monthly Status Report The contractor’s Transit Lead shall document the salaries paid in a detailed Monthly Status Report due on or before the 10th of each Month. The status report shall include, at a minimum:

Labor hours and hourly rate expended during the reporting period by individual, e.g., payrolls Cumulative hours expended throughout the reporting period by job category/positions by an incumbent employee Vehicle hours travelled by bus per route.

Problems encountered: identification of any problems filling positions, issues or delays in the delivery of the required positions, resolution recommendations, and any corrective action that was taken to correct identified problems.

b) Final Report

The contractor shall provide a final report to the COR at the conclusion of the service year. The report will summarize the staffing provided, significant issues that arose, and recommendations to improve the process in future service years.

d) General Work Requirements

The Contractor shall follow the general contract requirements set forth below:

a. Provide persons that are U.S. citizens, fluent in the English language, able to communicate orally and in writing, and have a basic familiarity with general office procedures. The contractor employees must be sufficiently qualified to assume duties at the Park with only general orientation to the VTS.

b. The Contractor shall be responsible for all personnel furnished under this contract and shall provide all required recruiting, vetting, testing, background checks, licensing, and other items directly related to employment. The contractor shall also be responsible for providing the minimum workers compensation, employer’s liability insurance, and such other insurance as the CO may require under this contract.

c. The Contractor shall be responsible for ensuring that each person is experienced and qualified to perform services in accordance with the Position Qualifications, described in the “Specific Tasks” section of the Statement of Work.

d. The Contractor shall be responsible for withholding taxes, paying all wages and fringe benefits, and meeting all requirements of the Service Contract Act.

e. The NPS reserves the right to reject, anytime without notice, any employee assigned who is either unable or unwilling to perform the work within the scope of the contract. The Contractor shall provide a substitute/replacement within 7 days.

f. The NPS will make every attempt to give the Contractor at least three business days’ notice for services. However, there may be times when the NPS will only be able to provide a one day notice. If an employee is not able to report to work, the Contractor shall notify the COR no later than 8:00 AM.

10. Quality Assurance:

The COR will review, for completeness, preliminary or draft documentation that the Contractor submits, and may return it to the Contractor for correction. Absence of any comments by the COR will not relieve the Contractor of the responsibility for complying with the requirements of this work statement. Final approval and acceptance of documentation required herein shall be by letter of approval and acceptance by COR. The Contractor shall not construe any letter of acknowledgment of receipt material as a waiver of review, or as an acknowledgment that the material is in conformance with this work statement. Any approval given during preparation of the documentation, or approval for shipment shall not guarantee the final acceptance of the completed documentation.

Quality assurance reviews, observations and inspections (ROI) by NPS staff shall be performed periodically. The NPS shall perform ROI on all areas of the VTS. The NPS reserves the right to perform ROI at any time, both announced and unannounced. During ROI the CO will inform the Contractor of all conditions which must be corrected and the time period the Contractor has to correct the condition. All corrective actions are subject to follow-up ROI by the CO or their designee.

All inspections performed by the CO or their designee are for the benefit of the government and do not absolve the contractor of the need to perform inspections of their own.

Attachment 04., titled Quality Assurance Surveillance Plan (QASP), indicates contractor tasks upon which the Government intends to evaluate the contractor’s performance via ROI. The Government and Contractor shall maintain a record of all ROI. At the end of each month the Government shall calculate the % of ROI for which the contractor was not in compliance with the contract requirements. When the % of non-compliance exceeds the acceptable quality level (AQL) noted below the contract price and subsequent invoiced amount shall be reduced by the noted Price Reduction.

The Government may enforce other contractual remedies including but not limited to termination for default, if the contractor performs significantly below the AQL and / or should the contractor’s performance not meet the AQL for two or more months within a one-year period.
