About this file

This is a Payment Bond document issued by Mt. San Antonio College, a California community college, establishing bonding requirements for contractors awarded work on the Technology and Health Building project. The document specifies that the Principal (contractor) and Surety must provide a labor and material payment bond equal to 100 percent of the contract price before commencing performance of work. The bond secures claims under California Civil Code sections 9000 through 9510 and 9550 through 9566, as well as Division 2, Part 7 of the California Labor Code. The bond protects all laborers, material suppliers, and other persons entitled to file claims for wages, materials, provisions, and other supplies used in project performance, including amounts required to be withheld and paid to the Employment Development Department under the Unemployment Insurance Code.

The Surety's obligations under the bond remain in full force regardless of any changes, extensions of time, alterations, or additions to the contract terms or specifications, with the Surety waiving notice of such modifications. In the event of the Principal's or subcontractors' failure to pay for labor, materials, or other supplies, the Surety commits to payment up to the bond amount and agrees to pay reasonable attorney's fees as awarded and fixed by the court. All signatories to the bond must provide notarial acknowledgments, and the Surety must furnish a Power of Attorney and Certificate of Authority. The bond inures to the benefit of all persons and entities entitled to file claims under California Civil Code section 9100, granting them direct rights of action against the bond. The Surety must be an admitted surety insurer authorized by the California Department of Insurance.
