About this file

This document is a specifications exhibit for a corrosion inhibitor contract with the Oregon Department of Transportation (ODOT), specifically detailing requirements for a sodium chloride brine corrosion inhibitor additive. The product must be listed on the Clear Roads Qualified Products List under Category A3 and have an add rate no greater than 20 percent. Deliveries are to be made to two specific locations in Oregon: a Progress Stockpile in Beaverton and a maintenance facility in La Grande, with strict delivery guidelines including advance notice, specific working hours, and temperature constraints.

The contract outlines comprehensive delivery and invoicing requirements, including mandatory documentation such as bills of lading, safety data sheets, and lot number tracking. Pricing and delivery terms include full transportation costs incorporated into the product unit price, with potential 25% price adjustments for improper delivery notifications. The Department retains the right to inspect, sample, and test the product upon delivery, with the potential to reject loads that do not meet specified requirements. Invoicing is contingent upon meeting all specified documentation and delivery standards, emphasizing a rigorous quality control and verification process for the corrosion inhibitor product.

EXHIBIT 1 - SPECIFICATIONS

CORROSION INHIBITOR FOR LIQUID SODIUM CHLORIDE BRINE

1.1. CORROSION INHIBITOR SPECIFICATIONS

1.1.1. This specification is for a corrosion inhibitor additive (“product”) for concentrated salt brine. The product must be listed on the current Clear Roads Qualified Products List under Category A3 and must conform at all times with the applicable Clear Roads specifications in addition to the requirements listed in this Exhibit 1. The Department (Oregon DOT) at its discretion may request a sample of the product at any time and test for compliance with requirements.

1.1.2. The product must have an add rate no greater than 20 percent.

1.2. DELIVERIES

1.2.1. All costs for transportation and delivery are included in the product unit price provided by Contractor.

1.2.2. Deliveries shall be made during normal working hours (Monday through Friday between the hours of 7:00 am and 3:00 pm MST), with a minimum of 24 hours advance notice of arrival time unless otherwise requested or agreed to by the Department. Any deliveries made without proper advance notification or outside of the established delivery times, unless otherwise authorized in advance and in writing, will be assessed an initial price adjustment of 25% of the purchase price of the product.

1.2.3. Contractor will be responsible for all necessary equipment to transfer product to the Department’s storage facility. Products, when mixed, must remain in liquid state and be able to be delivered and transferred to the Department’s storage tanks when ambient temperatures are > 0 ° F.

1.2.4. Each shipment shall be accompanied by a current and clearly legible SDS.

1.2.5. The bill of lading for each shipment must contain the following information:

1.2.5.1. Name of product

1.2.5.2. Supplier and manufacturer of product

1.2.5.3. Delivery destination

1.2.5.4. Total number of gallons being delivered

1.2.5.5. Total weight of delivery using a certified scale ticket

1.2.5.6. Lot or any other identification number for the product being delivered. The lot number is a specific number assigned to that particular product as delivered. This number must be denoted as the “LOT NUMBER” on the bill of lading and shall be clearly legible. The lot number must enable the Department to track a delivered product back to its manufacture point, date, and specific batch. Failure to have a defined LOT NUMBER that appears on the bill of lading is grounds for rejection of the load.

1.2.5.7. Transport information: Name of transporting company, tank trailer or rail car number, and point and date of origin.

1.3. INVOICING

The Department will not process invoices for payment until Contractor has met all requirements under this section. Each invoice shall include the following:

1.3.1. A copy of the original bill of lading

1.3.2. Purchase order number

1.3.3. Contract unit of measure

1.3.4. Total number of units delivered

1.3.5. Contract unit price for product delivered

1.3.6. Total price for units delivered

1.4. FIELD INSPECTION, UNLOADING, SAMPLING AND TESTING, TEST METHODS

Contractor shall not offload any product without affording the Department an opportunity to conduct the field inspection, sampling, or the testing. Offloading of product without affording the Department an opportunity to conduct said work shall deem the delivered product non-compliant and subject to total rejection. Contractor shall only offload product without field inspection, testing, and sampling by the Department when the Department representative grants prior written approval (email is sufficient).

1.5. F.O.B. LOCATIONS

Contractor shall deliver product to one of the following two locations, as specified in the order. Contractor retains responsibility for the product until it is delivered to the applicable delivery site.
