About this file

This document is a Phase 2 submission instruction guide for a federal design-build contract solicitation (W9128F26RA054) issued by the U.S. Army Corps of Engineers.

Offerors must submit two separate electronic volumes in PDF format with OCR capability via email. Volume I (Technical Proposal) contains Factor 4 – Technical Approach to the Sample Project, limited to 15 pages excluding Buy American Act discussion. The technical approach should describe all aspects of the design-build methodology, identify and mitigate technical risks, clarify any project phasing, list assumptions, and provide designer/A-E service capabilities including company name, CAGE Code/UEI, technical specializations, and design-construction coordination procedures. Offerors must also provide a draft project schedule in Gantt chart format (exempt from page limits) with critical activities and milestones including task order kickoff, design completion, manufacturing, permitting, site work phases, commissioning, performance verification, and closeout, but the schedule shall not include funding, pricing data, or narrative descriptions. Volume II (Price Proposal) contains Factor 5 and must include: (1) Binding Maximum Labor Rate Schedule (Section 00 10 00, Table 1) with unburdened and burdened hourly rates for all contract terms with no category title modifications; (2) Binding Maximum Indirect Rates (Table 2) with flexibility for Overhead/G&A based on accounting structure, supported by recent audit documentation or detailed cost pool breakdowns; (3) Escalation Rate (Table 3); and (4) Sample Project Pricing Bid Sheet (Table 4) requiring time-phased labor breakdown using only binding labor rates without discounting, documented indirect cost application using binding cap rates without discounting, maximum binding profit rate (sample project only, not included in base contract), and direct labor assumptions in bullet format that address gaps in contractual documents rather than restating compliance. The sample project involves interior and exterior renovations of approximately 3,600 square feet at Fort Carson, Colorado, Building 1959, to create a secure area meeting ICS 705 construction standards and SCIF accreditation requirements, with work limited to eight-hour days and five-day work weeks, commencing no later than 30 days after NTP (assumed August 2027) and completing within 450 calendar days. Davis-Bacon prevailing wage rates apply for El Paso County, Colorado, with Executive Orders 13706 and 13658 requirements regarding paid sick leave and minimum wage rates. Failure to submit complete proposals following all instructions and requirements may result in the Government considering the entire offer nonresponsive. All inquiries must be submitted through ProjNet Bidder Inquiry system with one question per inquiry only.

The hourly burdened labor rates proposed by the Offerors shall include direct cost, payroll taxes, insurance, benefits, and any other applicable labor costs (not already included in either the Offeror’s Indirect Rates) but shall exclude profit. Offerors shall provide an example of how the mark-ups are applied to the unburdened labor rates.

c. The hourly burdened labor rates proposed in Table 1 will be legally binding and will be the maximum rates that the Offerors shall use for all task orders and task order modifications issued during the five (5) year period of performance of the contract (base and option terms) and potential 6-month option, including the sample project.

d. The Government reserves the right to request information other than certified cost or pricing data from the Offerors, in order to assess the reasonableness of the proposed labor rates.

1.5.1.2 Binding Maximum Indirect Rates

a. The Offerors shall complete Section 00 10 00 Table 2 “Binding Maximum Indirect Rates” in its entirety. The binding maximum rates proposed in Table 2 will be legally binding and shall be the maximum rates that the Offerors will use on all task orders and modifications issued during the five (5) year period of performance of the contract (base and option terms) and the potential 6-month extension, including the sample project. Depending on an Offeror's accounting structure, the Offeror may have either Overhead/G&A or both. The intent is to provide Offerors the flexibility in proposing in accordance with its accounting structure. If an Offeror only has one (e.g. Home Office Overhead) and not the other (e.g.

G&A), the Offeror can mark whichever one as not applicable in the Binding Maximum Indirect Rates table.

b. The cost pools shall be in accordance with the Offeror’s most recent audited rates, if available.

1.5.1.3 Sample Project Pricing

a. The Offeror shall complete the Contract Rate Pricing Schedule (reference Section 00 10

00) in its entirety. The hours included in the Contract Rate Pricing Schedule represents an estimated number of hours for each of the labor disciplines based on historical contract information and anticipated level of contingency support that may be required for a project.

These hours are not contractually binding and are used only for evaluation purposes.

b. Offerors shall provide the following information (other than certified cost or pricing data) to substantiate the basis for the proposed lump sum price. Failure to provide the requested information may result in the Offeror being excluded from consideration for award. For the sample project effort, the Offerors should assume that they will self-perform the work.

1) Section 00 10 00 Direct Labor. Provide a time-phased (e.g., monthly, quarterly, etc.)

breakdown of labor hours, rates, and cost by appropriate category, and furnish basis for estimates. Offerors shall use only the Section 00 10 00 labor disciplines for the Direct Labor.

All other labor is included as part of the plug variable within the Materials and Services.

Offerors shall use the proposed hourly burdened labor rates in Section 00 10 00, Table 1 for the labor disciplines in pricing the sample task project. For the purposes of the sample project, Offerors shall not discount their proposed binding rates. Offerors that do not utilize the binding rates proposed in Section 00 10 00, Table 1 to calculate the price for the sample project will not be considered for award.

2) Indirect Costs (other than Profit). Offerors shall indicate how they have computed and applied their indirect costs. Offerors shall use the binding cap rates in Section 00 10 00, Table 2 in pricing the sample task order. For the purposes of the sample project, Offerors shall not discount their proposed binding cap rates. Offerors that do not utilize the binding cap rates proposed in Section 00 10 00, Table 2 to calculate the price for the sample project will not be considered for award. If the Offeror has additional indirect rates to those proposed in Section 00 10 00, the Offeror shall indicate the rate used and include a cost breakdown for the indirect rate. The Offeror shall show trends and budgetary data to provide a basis for evaluating the reasonableness of rate.

3) Profit: The Offeror shall propose their maximum binding profit rate for the purposes of the Sample Project Pricing, the Offeror shall not discount their maximum binding profit rate. Proposed profit applies only to the Sample Project and will not be included in the base contract. Profit will be negotiated at the task order level; refer to Section 00 10 00.

4) Direct Labor Assumptions: Offerors shall list all assumptions relevant to the direct labor in bullet format. Any assumptions that conflict with guidance provided in the solicitation documents will not be considered to be valid. Solicitation documents include, but not limited to, the drawings and specification, the Statement of Work (SOW), contract clauses, responses to requests for information (RFI), and any other document(s), attachment(s), and exhibit(s) provided by the Government for the requirement. The Government requires all assumptions that state that the proposal follows the guidance of contractual documents, including RFI responses, be removed from the price proposal.

The Government recognizes that some assumptions or statements of understanding may be required. In these situations, the Offerors shall submit assumptions as follows:

i) If the assumption is based on the contractual documents, including RFI responses, not addressing a situation, the assumption shall include the following:

• A description of the issue including the basis for the assumption (e.g. past experience at these locations, lesson learned, etc.)

• The proposed solution; and

• The cost impact of the proposed solution

NOTE: Offerors are discouraged from providing unrealistic solutions.

ii) If an Offeror believes that any of the contractual documents are conflicting or in error, after the RFI process, the assumption shall include the following:

• A general description of the conflicting or incorrect information with references to the location of the questioned information, such as the specific RFI response number, drawing sheet, specification section, or other contract document.

• The information that was used in the proposal. If there is a conflict between the specifications and drawing sheets, follow the guidance in FAR clause 52.236-21 Alt I.

• The cost associated with that information.

NOTE: If the RFI response resolves an error or conflict in a requirements document, an assumption stating that the RFI response and the original document are in conflict is not needed.

Attachment 00 21 16A

Sample Project

NOTE: The sample project has been scoped so that it captures a variety of activities that may be required under the contract. It should not be construed as indicative of typical project size.

It does not actually exist; as such as-built or concept drawings are not available.

Note: Executive Order 13658 generally applies to contracts subject to the Davis-Bacon Act that were awarded on or between January 1, 2015 and January 29, 2022, and that have not been renewed or extended on or after January 30, 2022. Executive Order 13658 does not apply to contracts subject only to the Davis-Bacon Related Acts regardless of when they were awarded. If a contract is subject to Executive Order 13658, the contractor must pay all covered workers at least $13.65 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract from May 11, 2026, through December 31, 2026. The applicable Executive Order minimum wage rate will be adjusted annually.

Additional information on contractor requirements and worker protections under Executive Order 13658 is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).

The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.

Union Rate Identifiers

A four-letter identifier beginning with characters other than SU, UAVG, SA, or SC denotes that a union rate was prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.

0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.

Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.

Union Average Rate Identifiers

The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:

UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.

The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.

A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.

Survey Rate Identifiers

The SU identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007 6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.

SU wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).

State Adopted Rate Identifiers

The SA identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.

The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the SA identifier took effect under state law in the state from which the rates were adopted.
