About this opportunity

The Utah Department of Transportation (UDOT) has issued a Notice of Intent to Award a Contract through a sole source procurement process for additional Bentley Systems EPS-365 subscriptions. The procurement specifically involves 32 Blueprint credits for SYNCHRO Construction E365 Tier 10 subscriptions, which will expand the existing contract #226134 that currently expires on 9/30/2024. The contract seeks to increase funding for Bentley software products that are deemed unique to UDOT's operational needs, with no changes to pricing, rates, or service levels. The public notice period for potential challenges runs from September 11, 2025, to September 19, 2025, during which interested parties can submit alternative supplier information or objections to mparry@utah.gov. This procurement method allows UDOT to proceed with contract award without standard competitive bidding if no valid challenges are received, based on the determination that the Bentley product meets specific agency requirements.

The sole source procurement does not specify any specific set-aside designations or restrictions on responding organizations. The current contract with Bentley Systems will increase from an original total of $1,904,599.00 to a proposed new total of $3,373,338.00, representing a 27.8% increase in contract value. The contract includes two potential one-year renewal options and is specifically for software subscriptions that support UDOT's construction and transportation planning activities. No specific disadvantaged enterprise requirements are mentioned in the documentation. The procurement is not a competitive solicitation but a formal notification of intent to award a contract through an alternative procurement method, with the understanding that parties who agree with the sole source determination need not take any action. The contract is anticipated to match the existing contract's term, ending on 9/30/2024, with potential extensions available.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS This is NOT a request for competitive solicitation. This is a public notice for comment regarding a proposed procurement without engaging in a standard procurement process if it is determined that the following exist: • there is only one source for the procurement item; or • transitional costs are a significant consideration in selecting a procurement item; or • the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. The intent of this notice is to determine if there are any other interested and qualified suppliers that meet the requirements of this procurement. For information regarding the specifics of this proposed procurement, please see the justification documentation attached within this notice. If a party agrees that this proposed purchase is a valid sole source, NO ACTION IS REQUIRED.
