About this opportunity

The Utah Department of Health and Human Services is seeking to award a contract for a Time-of-Flight Liquid Chromatography-Mass Spectrometry System from Agilent Technologies without engaging in a standard competitive procurement process, with a notice posted October 19, 2026 and a decision deadline of October 26, 2026. This is a sole-source procurement under Utah Administrative Rule R33-108-101c(3), contingent upon the Division of Purchasing issuing a written determination that standard procurement procedures are impractical.

The justification for bypassing competition centers on system compatibility. The Toxicology department's existing workflows, standard operating procedures, regulatory filings, and client-mandated test protocols were developed on the Agilent 6230 TOF platform and cannot be migrated to competing vendors' systems without extensive re-validation studies, instrument requalification, and data equivalency verification. The new system must integrate with existing Agilent 1260/1290 UHPLC hardware and process data directly through Agilent MassHunter PCDL software without third-party translation drivers or loss of proprietary metadata. Competitor raw files cannot be opened directly in MassHunter, making vendor interchangeability infeasible.

The scope includes a 6230C Accurate Mass TOF LC/MS system configured for comprehensive broad-spectrum drug screening of blood, urine, vitreous humor, and oral fluid samples; identification of novel psychoactive substances including synthetic opioids and designer cathinones; retrospective data mining of historical patient and forensic files; and metabolite profiling. The package comprises the primary instrument, MassHunter Workstation Software upgrade, binary and isocratic pumps, multicolumn thermostat, vial sampler, Quick Change valve heads, splitter assembly, connection fittings, and three-year extended warranty. Installation, introduction training, and one-year software update and phone assistance are included.

The contract value is $258,232.15 USD (F.O.B. Destination, Freight Prepaid). The estimated delivery timeframe is five weeks from order placement. Payment terms are Net 30 days. The quote from Agilent Technologies is effective through January 4, 2027.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
