About this opportunity
Summit County is requesting proposals from qualified attorneys to serve as a land use administrative law judge under a one-year contract with renewal options, with proposals due September 1, 2026. This is a newly created position mandated by amended Utah Code section 17-79-1001, which prohibits county councils from serving as land use appeal authorities; the ALJ replaces the County's Board of Adjustment function.
Respondents must be members in good standing of the Utah Bar and must possess experience conducting administrative or quasi-judicial hearings related to land use matters. Required qualifications include demonstrated knowledge of constitutional due process rights and excellent legal writing skills. The ALJ will review documents, conduct hearings, and draft formal decisions on appeals from decisions made by the Community Development Director, County Manager, and two planning commissions regarding land use matters including use interpretation, subdivision disputes, conditional use permits, variances, code enforcement, and nightly rental matters. Hearings are scheduled approximately once per month for approximately two hours each, with additional or emergency hearings as necessary. Hearings will be held at 60 North Main Street, Coalville, Utah 84017 or electronically at the ALJ's discretion.
Respondents must maintain professional liability insurance with limits of not less than one million dollars per occurrence and workers' compensation insurance with minimums of five hundred thousand dollars per accident.
Proposals are limited to five pages and will be evaluated on qualifications (35 points), relevant experience with similar projects (30 points), availability (5 points), and fee structure and rates (30 points). No contract value or compensation amount is specified in the RFP. Questions are due August 14, 2026. Proposals remain valid for 90 days after submission. Summit County reserves the right to reject any or all proposals and may conduct interviews before final selection by the County Manager.
Opportunity text
Summit County ("County") is inviting qualified attorneys to submit proposals to perform the duties of a land use administrative law judge ("ALJ"). The County seeks to contract with an attorney with experience and expertise in land use to fill a new position as a land use ALJ, created in part to comply with amended Utah Code section 17-79-1001, which prohibits a county from designating the county council as the appeal authority, and as a result of the County's decision to replace the Board of Adjustment with an ALJ. The ALJ will hear and determine primarily matters related to land use, but the ALJ may hear additional types of cases at the discretion of the County. The ALJ will review documents submitted, conduct hearings, and draft formal decisions. Hearings will be scheduled once per month, absent unusual circumstances, on a date and time agreed upon by the ALJ and the County.
