About this opportunity

The State of Utah, Division of Purchasing and General Services, seeks to award a sole-source contract for equipment maintenance services for a nitrogen generator (Serial No. 770001760, Model SL2a-Tier-NANM32LA-A-SL010-6025-SL0) supporting the Utah Department of Agriculture and Food (UDAF) laboratory's analytical operations. This Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process was posted on May 18, 2026, with a due date of May 25, 2026. The procurement encompasses comprehensive maintenance and repair services for the nitrogen generator, which provides continuous high purity nitrogen (greater than 99.0% purity with hydrocarbons less than 1 ppm) for laboratory testing of plant materials, soil, medical cannabis, hemp, animal feed, and kratom. The service contract includes one to two on-site preventative maintenance visits per year conducted by a manufacturer engineer, full function checks, component retrofits, compressor repair or replacement when required, breakdown and repair services with a five-working-day on-site response time, and online technical support. The anticipated contract commencement is July 2026, with a preventative maintenance visit scheduled for August 2026 and annual visits required each August thereafter. The contractor must maintain the nitrogen generator in good operating condition and issue certificates of analysis outlining qualified and quantified alkaloids and cannabinoids within 14 days of sample receipt. Key qualifications include authorization as the original equipment manufacturer and sole provider capable of servicing Peak Scientific gas generators throughout North America.

This procurement is restricted to Peak Scientific Inc., the sole authorized provider for service, original equipment manufacturer parts, technical support, and contractual maintenance for all Peak Scientific gas generators in the North American territory, making this a non-competitive sole-source award justified under the Utah Procurement Code due to the unavailability of alternative sources. No set-aside designations for disadvantaged enterprises or other organizational restrictions are noted in the documentation. Peak Scientific Inc., located in Westford, Massachusetts, is the incumbent contractor and current service provider, with previous service contracts from the 2023-2024 period demonstrating significant value by providing over $10,000 in consumable parts and repairs with zero laboratory downtime while simultaneously reducing costs associated with purchasing high-purity nitrogen cylinders. The contract eliminates reliance on costly and disruptive delivered gas cylinders and ensures uninterrupted analytical capability for UDAF's regulatory investigation and testing operations. The estimated contract value is $5,947.83 for the service agreement renewal, effective April 16, 2026, through April 15, 2027, with payment terms of Net 30 Days from the Date of Invoice. The renewal deadline is the end of June 2026, and the contract award is contingent upon written determination by the Division of Purchasing that the sole-source justification is valid.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
