About this opportunity
The State of Utah Division of Purchasing has published a Notice of Intent to Award a Contract Without Competition for Overdrive services, with a posted date of March 18, 2026, and a response deadline of March 25, 2026. This procurement represents a non-competitive award process, meaning the Conducting Procurement Unit intends to bypass standard competitive bidding procedures. The justification for this single-source award is based on one or more statutory criteria: the existence of only one available source for the procurement item, significant transitional costs associated with changing providers, or circumstances that render standard procurement processes impractical and contrary to the procurement unit's best interests. The specific scope of services, deliverables, key objectives, required qualifications, and evaluation criteria are contained within the supporting documentation files accompanying this notice, particularly the detailed justification statement provided in the 2-Part 8 Notice. Bidders and interested parties must review all submitted documentation to understand the complete nature of the Overdrive services being procured, the project requirements, quantities, contract terms, and timeline expectations. The Division of Purchasing is required to make a written determination approving or denying the non-competitive award request based on the justifications and supporting evidence provided by the Conducting Procurement Unit.
The available documentation does not specify set-aside designations, minority or disadvantaged enterprise restrictions, or limitations on organizational types eligible to respond. No incumbent vendor or current contractor information has been disclosed in the posted materials, nor is there identification of existing infrastructure or technology requiring integration with the proposed Overdrive services contract. Similarly, the procurement documents provided do not disclose the anticipated award value, budget range, or contract pricing information. Entities seeking to submit bids or proposals must comply with the Utah Government Records Access and Management Act (GRAMA) procedures, including the option to submit Business Confidentiality Claims for trade secrets and commercially sensitive information using the prescribed claim form, with both redacted and non-redacted versions of proposals required. Claimants bear responsibility for identifying specific pages, paragraphs, and justifications for confidentiality requests, and submission of such claims does not guarantee protective classification if public records requests are subsequently received. Interested vendors should submit all required documentation and confidentiality claims simultaneously with their proposals to meet the March 25, 2026 deadline.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
