About this opportunity

The West Virginia Department of Environmental Protection, Office of Special Reclamation, issued an Agency Request for Quote (ARFQ DEP2200000001) on July 9, 2021, for establishing an open-end master agreement to provide maintenance services for Northern Maintenance Region 1, which encompasses ten counties including Barbour County. The procurement encompasses 101 line items spanning heavy equipment rental, materials, labor, and specialized services required for site reclamation and maintenance operations, including crawler dozers, excavators, loaders, graders, and pumps; various stone types, piping systems, and geomembranes; and labor-intensive tasks such as revegetation, hydroseeding, and erosion control measures. Individual work directives will not exceed $25,000 each, with a Notice to Proceed required before work begins and a one-year warranty period commencing from the final date of service. Vendors must submit all bids electronically through the wvOASIS Vendor Self Service Portal with pricing provided on a unit basis, with technical questions due by July 15, 2021, and bids closing on July 27, 2021, at 10:30 a.m. Required qualifications include a valid West Virginia contractor's license, capability to supply equipment, labor, and materials on multiple concurrent or consecutive projects, designation of a primary contract manager available during normal business hours, and identification of a base location for mobilization purposes. The contract structure requires vendors to establish unit prices for each line item with quantities to be determined by actual project needs throughout the contract term.

No set-aside designations or restrictions specific to disadvantaged enterprises are identified in the solicitation documents. Bidders must submit a bid bond equal to five percent of the total bid amount and provide a signed and notarized drug-free workplace affidavit certifying compliance with West Virginia Code 21-1D-5, along with a West Virginia Department of Environmental Protection Procurement Affidavit affirming no outstanding debts to the state or its political subdivisions. Immediate disqualification grounds include failure to sign required signature pages, failure to submit valid bid bonds, non-compliance with mandatory requirements, failure to acknowledge addenda when required, late bid submission, federal or state debarment or suspension, and outstanding environmental enforcement actions. Additional requirements that must be resolved prior to contract award include resolution of any Workers' Compensation or Unemployment Compensation delinquency, proof of required bonds and insurance, and submission of a complete subcontractor listing. The contract is an open-end time and materials agreement with an initial term of one calendar year, renewable for up to three successive one-year periods upon mutual written consent and Attorney General approval, with total payments not to exceed $500,000 inclusive of all payments for the contract term and all renewals. Contact for inquiries is Linda L. Stanley at the West Virginia Department of Environmental Protection, reachable at (304) 926-0499 or linda.l.stanley@wv.gov.
