About this opportunity

Nebo School District's Department of Purchasing in Utah is publishing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process to Maxim Healthcare Services, Inc. for private nursing services, with a challenge period closing July 29, 2026. This is a sole-source procurement justified by continuity of care for medically fragile students already receiving out-of-school nursing services through Maxim, where maintaining alignment with existing providers and the nurses trained in students' complex medical needs reduces health-related risks and transition costs.

The scope covers 1:1 nursing care during school hours for students in Special Education or the 504 program who currently receive Maxim nursing services outside school. Deliverables include medication administration, medical procedure implementation per individualized health plans, emergency medical response, daily documentation, family and staff communication, and participation in team meetings and training. All assigned nurses must hold valid Utah nursing licenses (RN or LPN), complete student-specific health plan training, undergo district-mandated orientation and safety training, and satisfy background check requirements under Utah law and district policy. Nurses operate under the school nurse's direction, maintain FERPA and HIPAA compliance, and adhere to district documentation and communication protocols.

The estimated contract value is $120,000 per year for a five-year term running August 1, 2025 through July 31, 2030, with no freight costs. The contract applies only to students currently receiving Maxim services outside school; other contracted vendors will continue serving the majority of students requiring school-day nursing support. Vendors must carry commercial general liability insurance of $1 million per occurrence and $3 million aggregate, maintain workers' compensation coverage, register with the Status Verification System, and verify worker eligibility through E-Verify. The District will conduct annual performance reviews and may terminate immediately upon written notice for failure to meet performance standards or legal compliance. Interested vendors may submit detailed challenges with supporting documentation demonstrating that competing sources exist during the public notice period.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS Nebo School District, Purchasing Department publishes this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Purchasing Department claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: there is only one source for the procurement item; transitional costs are a significant consideration in selecting a procurement item; or the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
