About this file

This is a Statement of Work for a sole source contract between Nebo School District in Utah and Maxim Healthcare Services, Inc, outlining a five-year nursing care services agreement. The contract, effective August 1, 2025, through July 31, 2030, establishes the scope for providing qualified and licensed nursing staff to deliver 1:1 nursing care to medically fragile students during school hours who currently receive out-of-school nursing services from Maxim. The services encompass medication administration, medical procedure implementation as specified in student health plans, emergency medical response, daily documentation, family and staff communication, and participation in team meetings and training. All assigned nurses must hold valid Utah nursing licenses (RN or LPN), complete training specific to each student's individualized health plan, undergo district-mandated orientation and safety training, and satisfy background check requirements in accordance with Utah law and district policy.

The contract is structured as a sole source procurement justified by continuity of care considerations, recognizing that transitional costs and the benefits of maintaining alignment between in-school and existing out-of-school nursing providers are significant factors supporting award without standard competitive process. The target population is limited to students already receiving nursing services from Maxim outside school hours, where provider continuity reduces health-related risks and promotes emotional stability. Performance requirements mandate nurse punctuality, reliable attendance, and adherence to FERPA and HIPAA compliance standards. All nursing staff operate under the direction of the school nurse and coordinate with the educational team while maintaining documentation and communication protocols established by Nebo School District policy.
