About this opportunity

Granite School District, located in Salt Lake County, Utah, is issuing a Notice of Intent to Award Without Engaging in a Standard Procurement Process for Ellevation, pursuant to Utah Code Part 63G-6a Part 8 and Utah Administrative Code R33-108. This procurement is not a standard competitive bidding process and does not constitute a request for quotes, bids, or proposals. The District intends to award a contract for Ellevation without conducting a competitive procurement, citing one of the statutory justifications available under Utah law: that only one source exists for the procurement item, that transitional costs are a significant consideration, or that circumstances make standard procurement impractical and not in the best interest of the District. The notice period opened on May 11, 2026, with a deadline of May 19, 2026, for any potentially qualified vendors to challenge the intent to award by submitting detailed documentation to Adar Livni-Sullivan at alivni@graniteschools.org. Vendors wishing to contest this award must provide their company name and contact information, detailed justification for their challenge with supporting documentation of competing sources, proof that they can provide a comparable or superior product meeting the specifications, and a cost comparison of transitional expenses if applicable.

No set-aside designations or restrictions on vendor eligibility have been specified in this notice. The specific incumbent vendor, Ellevation, appears to be the sole proposed awardee, though the record does not identify the current contract value or budget range associated with this procurement. The attached Standard Information Technology Terms and Conditions document indicates this is an IT-related services or software procurement, suggesting that the successful contractor must comply with comprehensive data security requirements including U.S.-based data center storage with minimum 128-bit encryption, breach notification within seventy-two hours, federal criminal background checks for employees with student access, and standard insurance requirements including one million dollars in commercial general liability per occurrence and three million dollars aggregate. The contract terms specify a one-year warranty for hardware and ninety-day warranty for software, with a sixty-day termination for convenience clause, though no explicit contract duration or award amount is disclosed in the available documentation.

Issuing and Conducting Procurement Unit: Granite School District In accordance with Utah Code Part 63G-6a Part 8 and Utah Administrative Code R33-108, this is a notice of intent to award without engaging in a standard procurement process. It is not a request for quotes, bids or proposals. DO NOT submit questions, bids, no-bids or other information in this system. NO ACTION IS REQUIRED IF YOU AGREE WITH THIS NOTICE. If there are any other qualified vendors that meet the specifications of this notice, any such vendor must submit the following information via email only to Adar Livni-Sullivan at alivni@graniteschools.org prior to the event close date. The name of the contesting vendor and contact person; and a detailed explanation of the challenge, including documentation showing that there are other competing sources for the procurement item. In addition, a vendor must include: Documentation that the vendor can provide a comparable or better procurement item that meets or exceeds the specifications; documentation that the vendor can also provide the same proprietary procurement item or an equivalent procurement item; and if transitional costs are identified as the justification for this notice, submit a cost comparison of the identified transitional costs with the vendor's anticipated transitional costs. NOTICE OF INTENT TO AWARD WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Utah Procurement Code provides that a purchase may be made without engaging in a standard procurement process if it can be determined in writing that: there is only one source for the procurement item; transitional costs are a significant consideration in selecting a procurement item; or the award of a contract is under circumstances, described in rules adopted by the applicable rule making authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. Granite School District Purchasing Department has received a request to make the following award without engaging in a standard procurement process: Requesting School/Department: Access & Opportunity Department Product and/or service to be purchased: Ellevation Legacy Earliest date purchase may occur: 7/1/2026 Proposed Supplier: Curriculum Associates, LLC Justification: * Cost Benefit Analysis not published but filed with paperwork. Transitional costs are a significant consideration in selecting a procurement item and the results of a cost-benefit analysis demonstrate that transitional costs are unreasonable or cost prohibitive, and that the award of a contract without engaging in a standard procurement process is in the best interest of the procurement unit. Ellevation is software used by many professionals at the Granite School District including teachers, para-educators, and counselors. It is estimated that training would require a half-day training costing $150 per teacher and counselor and $16 per hour for a para-educator. There are around 3,500 teachers, 1,500 para-educators, and 300 counselors. The total cost to train our staff in new software would be $642,000. Length of notice: Granite School District intends to purchase these products for the next, 2026-2027, school year. Anticipated expenditure: $381,906.36
