About this opportunity

The Texas Health and Human Services Commission (HHSC) Procurement and Contracting Services division, on behalf of the Women, Infants and Children (WIC) program with potential utilization by the Department of Family and Protective Services (DFPS) and Department of State Health Services (DSHS), is soliciting bids for breast pumps, breast pump accessories, and technical support under Invitation for Bid (IFB) HHS0007034. The procurement encompasses five primary product categories: multi-user electric pumps, single-user electric pumps, manual pumps, sterile milk collection kits with multiple sized breast flanges, and replacement parts and accessories. All electric pumps must feature adjustable cycling rates of 60-72 cycles per minute, include instructional videos in English and Spanish with closed captioning, provide FDA 510(k) market clearance confirmation, and include a minimum of two pairs of breast flanges in different standard sizes measured in millimeters. Multi-user electric pumps must be UL-listed or equivalent and operate on 100-volt electrical outlets, with capacity for up to 100 annual disinfestation treatments or repairs. Respondents must submit product samples by May 11, 2020, with sealed bids due April 27, 2020 at 2:00 PM Central Standard Time; the HSP (HUB Subcontracting Plan) is due by May 15, 2020 at 2:00 PM CST. The contract term runs from September 1, 2020 through August 31, 2021, with three optional one-year renewals available. Performance requirements include a three-year warranty for multi-user electric pumps, one-year warranty for single-user pumps and kits, ninety-day warranty for manual pumps, delivery within 45 days of order notification, designated technical support available Monday through Friday from 8:00 AM to 5:00 PM Central Time, and provision of a minimum of three and maximum of five business references demonstrating similar work completed within the past two years. Award consideration will be based on cost, experience and performance record, and capabilities, with HHSC reserving the right to make awards on the basis of low line item bids, low total bids, or any combination serving the best interest of the State, and the agency may make multiple or partial awards.

This solicitation includes a mandatory statewide HUB (Historically Underutilized Business) utilization goal of 21.1 percent for commodities procurement, with all respondents required to submit a completed HUB Subcontracting Plan regardless of subcontracting intentions. Respondents selecting Method B must notify at least three Texas-certified HUBs and two trade organizations or development centers for each subcontracting opportunity, allowing a minimum of seven working days for responses prior to bid submission; all notifications and communications must be documented and submitted with the proposal. All insurance policies must be issued by companies authorized to do business in Texas and rated A or better by A.M. Best Company, with required coverage including workers' compensation with $1,000,000 employer's liability limits, commercial general liability with $1,000,000 per occurrence and $2,000,000 general aggregate limits, comprehensive automobile liability with $1,000,000 combined single limit, umbrella liability of at least $1,000,000, and cyber/privacy liability insurance with $1,000,000 claim and aggregate limits. Historical annual ordering data from fiscal year 2019 indicates significant procurement volumes, including 96 multi-user electric pumps, 12,425 single-user electric pumps, 12,280 manual pumps, 10,300 milk collection kits, and 960 additional sized flanges, though HHSC explicitly reserves the right to increase or decrease quantities based on operational requirements and provides no guarantee of future purchase amounts. All award notices exceeding $25,000 will be posted to the Comptroller's Electronic State Business Daily (ESBD), and vendors must pass debarment status checks, franchise tax status verification, and system exclusion list reviews before award consideration.
