About this opportunity
Northeastern Junior College (NJC) in Sterling, Colorado, located in Lincoln County, is soliciting proposals for snack vending services through a Disability Set Aside (DSA) procurement. The solicitation requires a vending contractor to provide and maintain a minimum of nine state-of-the-art snack vending machines across NJC's main and north campuses, excluding beverages except milk, coffee, hot tea, and hot chocolate. At least half of the machines must accept credit card payments, and all machines must accept $1 and $5 bills with monthly sales reporting capabilities. The contractor's deliverables include twice-weekly machine stocking during the academic year, weekly maintenance checks, 24-hour service response times during business hours and within 24 hours after hours, and operation of a refund bank system for lost patron funds. The contractor must bear all operational costs including snack purchases, supplies, equipment maintenance, cleaning, restocking, employee wages, and applicable sales and tourism taxes, while remitting a percentage of gross sales revenue to NJC to be proposed by the bidder. Historical gross sales data from 2013-2014 totaled $18,694.15 across all nine locations. Proposals must include a detailed work plan, snack purchasing practices to ensure product freshness, contract administration contact information, the percentage of total contract price allocated to employee salaries excluding administrative staff, and the percentage of gross sales to be returned to NJC. The quote submission deadline was February 6, 2015, at 4:00 p.m., with an intended contract start date of July 1, 2015, an initial one-year term, and four optional one-year renewal periods by mutual agreement. NJC reserves the right to terminate the contract with 30 days' written notice for non-performance or violation of contract terms.
This is a Disability Set Aside contract requiring the winning vendor to meet specific qualifications as either a Service-Disabled Veteran Owned Small Business, small business, minority business, or women-owned business (M/WBE). Vendors must complete a Form W-9 Substitute Form certifying their taxpayer identification number and self-certifying their status as an M/WBE by providing gender ownership information and owner ethnicity, along with confirmation of small business status defined as an independently owned and operated for-profit business with 25 or fewer full-time equivalent employees. All contracting vendors must comply with the State of Colorado's standard Purchase Order Terms and Conditions effective January 1, 2009, Special Provisions, and Vendor Disclosure Statement requirements, including verification of employment eligibility through the E-Verify Program, maintenance of workers' compensation and unemployment insurance, and disclosure of any services performed outside the United States or Colorado. The contract incorporates Colorado Uniform Commercial Code provisions regarding warranties and requires independent contractor status with no employee relationship to the State. Payment terms require the State to remit all amounts due within 45 days after receipt of products or services and an acceptable invoice, with interest accruing at the statutory rate specified in CRS 24-30-202(24) beginning on the 46th day for unpaid balances. While no specific incumbent vendor is identified in the solicitation materials, the contract value is based on the contractor's proposed percentage of gross sales revenue returned to NJC, with historical baseline sales data of approximately $18,694 annually providing insight into potential award value.
