About this opportunity
The Kansas Department of Health and Environment is requesting competitive proposals for construction of the Mussa Abandoned Mine Land (AML) project in Cherokee County, Kansas, with proposals due September 10, 2026 at 2:00 PM CST and a mandatory pre-bid conference on August 26, 2026 at 8:30 AM CST in Frontenac.
The scope encompasses site stabilization and reclamation of approximately 42.52 acres at an abandoned mine site, including site mobilization, clearing and grubbing, earthwork operations (grading, rock toe, spillway construction, rock channel, boat ramp, and wetland construction), geotextile and culvert installation, final grading, seedbed preparation, seeding, erosion control measures, and fencing. The contractor must develop a site-specific health and safety plan addressing potential sinkholes and vertical openings, maintain all best management practices through vegetation establishment, and utilize the eastern construction area as a continuous borrow source. Approximately 4,800 square feet of KDOT 18-inch light rip rap is proposed for slope stabilization.
The contract runs from October 1, 2026 through June 30, 2027. Liquidated damages of $2,500 per week apply if work is not completed by June 30, 2027. Payment is structured as monthly lump-sum invoicing based on project percentage completed, subject to 10% retainage that may be released after 50% project completion.
Davis-Bacon prevailing wage requirements and Buy American Building Materials Act (BABA) provisions apply to all work and subcontractors. A 5% bid guarantee (certified check, cashier check, certificate of deposit, or bid bond) is required, payable to the State of Kansas. Performance and payment bonds are mandatory. All bidders must register with the State of Kansas, provide tax clearance certificates, and complete mandatory certifications including AML Contractor Form (OMB #1029-0119) through the Applicant Violator System (AVS), debarment and suspension status, drug-free workplace compliance, lobbying disclosures, immigration reform compliance, sexual harassment policies, Israel boycott certifications, and restricted telecommunications equipment restrictions. Pre-bid attendance is mandatory with sign-in/sign-out documentation required. Written questions are due August 28, 2026. Award will be based on cost, proposal adequacy and completeness, bidder's understanding of the project, compliance with RFP terms, experience providing similar services, qualified staff, and proposed methodology.
