About this file
This is a certification and compliance form from the U.S. Department of the Interior's Office of Surface Mining Reclamation and Enforcement, applicable to the Mussa Abandoned Mine Land (AML) Project in Cherokee County, Kansas, administered by the Kansas Department of Health and Environment. The document establishes mandatory certifications that prospective participants must complete and submit as a prerequisite for contract award. The form consolidates five certification requirements into a single document and serves as a material representation of fact upon which the contracting agency will rely when determining contract eligibility and award decisions.
The certification requirements encompass debarment and suspension status verification, responsibility matters for both primary and lower-tier covered transactions, drug-free workplace compliance, and lobbying disclosures. Prospective participants must certify they are not debarred, suspended, or otherwise ineligible; have not been convicted of fraud or criminal offenses related to public transactions within the preceding three years; and are not currently indicted or criminally charged. For non-individual applicants, drug-free workplace certification requires establishing workplace policies, awareness programs, employee notification procedures, and reporting mechanisms for drug-related convictions. Lobbying certification applies to awards exceeding $100,000 and requires disclosure of any non-federal funds used for influencing government officials. Participants unable to certify any statement must provide written explanations. Failure to submit required certifications subjects parties to civil penalties ranging from $10,000 to $100,000 per violation. Authorized certifying officials must sign the form with typed name, title, and date.
