About this opportunity

The Utah Division of Purchasing has published a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for maintenance of mailing equipment, with a challenge period closing July 14, 2026. This is a sole-source procurement; no competitive bidding will occur unless a valid challenge is received during the notice period.

The Utah State Tax Commission is the conducting procurement unit seeking annual maintenance, repair, and software updates for OPEX mailing equipment used for document scanning. The equipment is no longer in production but remains in active use. OPEX Corporation is the sole identified source; the agency's market research — including contacts with Pitney Bowes, DMT Solutions, and Quadient — confirmed that OPEX is the only authorized dealer capable of servicing this legacy equipment. Competitors may resell OPEX equipment but are not authorized to perform maintenance on the existing machines.

The estimated contract value is $51,230 with no freight costs. The contract term and renewal options are not specified.

The justification for sole-source award rests on the age and proprietary nature of the OPEX equipment and the unavailability of alternative service sources. The agency determined that modifying the scope to allow competition is impractical because the procurement aims to maintain existing equipment rather than replace it.

Vendors who believe they can provide comparable, equivalent, or superior services must submit detailed documentation during the challenge period, including proof of capability to meet or exceed specifications and any applicable cost comparisons. All contractors must certify compliance with Utah Code 63G-27 et seq. regarding boycott prohibitions, specifically certifying non-engagement in economic boycotts or boycotts of the State of Israel. Vendors should direct questions to the Division of Purchasing and must not contact the State Tax Commission directly.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
