About this opportunity
The Office of the Attorney General of the State of Utah seeks to establish multiple professional service agreements with law firms to provide general litigation services in civil, administrative, appellate, and alternative dispute resolution matters. Successful offerors will be placed on an eligible list of prequalified law firms for a five-year contract period and may be engaged on an as-needed basis to represent the State of Utah, state agencies, or the OAG in state and federal courts, administrative tribunals, and alternative dispute resolution proceedings. Each responding firm must designate a Litigation Team consisting of a Lead Counsel with at least ten years of complex litigation experience in the designated subject area (including jury trial experience), one or more Senior Counsel with at least five years of experience, up to two Junior Counsel, and at least one paralegal, with all attorneys maintaining active licensure in at least one state or District of Columbia bar and one federal district court bar in good standing. Mandatory minimum requirements include legal malpractice insurance coverage of at least $5,000,000 per incident, background checks, certification of non-debarment status, and a defense-oriented practice with preferential experience representing public entities and familiarity with Utah's Governmental Immunity Act and qualified immunity principles. Evaluation will occur in two stages: technical evaluation utilizing a 500-point scoresheet weighted 40 percent for lead counsel and senior attorney qualifications, 20 percent for litigation team qualifications, 30 percent for complex litigation experience and results, 5 percent for reference materials and insurance documentation, and 5 percent for cost proposals, with a mandatory 350-point threshold (70 percent) required for contract consideration; cost evaluation will award 100 percent cost points to the lowest-cost vendor with proportional points assigned to others based on price differential. Proposals must be submitted electronically through the Utah Public Procurement Place (U3P) by April 27, 2026, with all vendor questions directed to the designated procurement officer during the question and answer period; pricing must be guaranteed for one year with any annual adjustments thereafter limited to five percent and requiring sixty days' written notice with supporting market analysis documentation.
The procurement documents do not identify set-asides for disadvantaged enterprises, women-owned businesses, minority-owned businesses, or other specific organizational restrictions; however, all responding vendors must comply with Utah Code provisions regarding anti-boycott actions, restricted foreign entities, and forced labor prohibitions, and must participate in E-Verify employment eligibility verification. No incumbent vendors or current contractors are identified in the RFP materials. Compensation will be structured as hourly fees for Lead Counsel, Senior Attorneys, Junior Attorneys, and Paralegals, with specific rates to be proposed on the cost proposal form; the OAG will reimburse approved litigation costs and expenses including travel in accordance with Utah Administrative Code at 100 percent of actual amounts incurred with no administrative overhead surcharge, although internal expenses such as document storage, legal research platform subscriptions, and general secretarial work will not be reimbursed. No specific contract award values or budget ranges are provided in the available procurement documents. All work product and custom deliverables developed under the resulting professional service agreements will be owned by the State Entity, and contractors must indemnify the State from claims related to intellectual property infringement; the OAG retains full control over case management, pleadings, and settlement authority with the right to terminate any PSA upon written notice, limiting compensation to fees and costs earned through termination plus reasonable case transfer costs.
