About this opportunity
The State of Utah Division of Purchasing, on behalf of the Division of Oil, Gas and Mining's Abandoned Mine Reclamation Program, is issuing a Request for Statements of Qualifications (RFSQ) under Utah Procurement Code 63G-6a Part 15 to procure qualified professional engineering services for the Kenilworth Mine Fire Project located in Carbon County, Utah. The procurement seeks engineering firms to evaluate the abandoned mine project area, characterize public safety and environmental hazards, and develop comprehensive reclamation designs to mitigate those hazards. Primary deliverables include Phase I and Phase II investigation reports due by November 30, 2026; a cultural resources inventory report compliant with the National Historic Preservation Act Section 106 process; engineering and design plans utilizing a 30/60/90 percent phase approach with multiple mitigation options; bid-ready construction specifications with detailed drawings and cost estimates; and full-time construction management and inspection services, with all project work completion required by October 1, 2027. The contract is awarded as a five-year time-and-materials engagement with compensation based on actual costs including direct labor categorized from P1 (Junior Professional) through P5 (Principal Professional) and technical levels T1 through T4, plus direct non-labor costs such as travel at GSA per diem rates, reproduction, supplies, and approved subcontractor fees. Evaluation will be based on technical qualifications alone without pricing submissions, with scoring across criteria including field investigations, cultural and historic surveys, engineering and design capabilities, construction specifications development, construction management experience, mapping and GIS services, and examples of previous work on a scale yielding up to 680 total points. All work must be performed by or under direct supervision of a professional engineer registered in Utah with a civil or mining engineering license, and all archaeological work must be conducted by a Secretary of Interior-qualified archaeologist with Registered Professional Archaeologist (RPA) certification; vendors must demonstrate experience with underground coal fire investigations, geophysical surveys, mine reclamation design, and construction management for abandoned mine projects. The response deadline is February 26, 2026, with questions submitted through the U3P system during the specified question and answer period; the highest-ranked vendor will be selected to negotiate a contract at fair and reasonable compensation, and if negotiations fail, the State may proceed with the next highest-ranked vendor.
The solicitation does not indicate set-aside designations for disadvantaged enterprises or restrictions limiting response eligibility to specific organization types, nor are there any identified incumbent vendors or current contractors referenced in the procurement documents. No existing infrastructure or technology requiring integration is specified in the available materials. The procurement documents do not provide explicit budget ranges or award values; compensation will be determined through good faith negotiation following vendor selection based on qualifications. The project is funded through the U.S. Office of Surface Mining Reclamation and Enforcement and the State of Utah, with contract award and authorization contingent upon fund availability. Liquidated damages are established at $200 per calendar day for work not completed by agreed deadlines. Vendors must comply with mandatory state requirements including certification of compliance with anti-boycott provisions under Utah Code Annotated 63G-27, confirmation of non-use of forced labor products or restricted foreign entity technology under UCA 63G-6a-121, participation in the Status Verification System (E-Verify), and maintenance of insurance coverage including workers' compensation, commercial general liability of $1,000,000 per occurrence and $3,000,000 aggregate, and commercial automobile liability of $1,000,000 per occurrence.
