About this file
This file is a Business Confidentiality Claim Form issued by the Utah State Archives Office of the Government Records Ombudsman in conjunction with the State of Utah Division of Purchasing for the JH26-39 Kenilworth Mine Fire Project. The procurement seeks qualified professional engineering services from the Utah Division of Oil, Gas and Mining's Abandoned Mine Reclamation Program to evaluate an abandoned mine project area, assess associated public safety and environmental hazards, and develop reclamation designs to mitigate those hazards. The contract term is five years, with all deliverables due by October 1, 2027. This Request for Statements of Qualifications (RFSQ) is issued under Utah Procurement Code 63G-6a Part 15 for the selection of Design Professional Service Providers and Consultants, with the highest-ranked vendor selected to negotiate a contract at fair and reasonable compensation determined through negotiation with the state.
The confidentiality claim form allows vendors submitting proposals to protect trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309 by designating specific pages, paragraphs, and sections of their submission as confidential. Claimants must submit both redacted and non-redacted versions of their proposals, with the Division of Purchasing declining to perform redactions on behalf of vendors who fail to provide a redacted copy. The form requires vendors to provide a concise statement of reasons supporting their confidentiality claims and specifies that making a confidentiality claim does not guarantee protected classification if the government receives subsequent records requests under the Government Records Access and Management Act (GRAMA). Pricing information should not be included in qualifications submissions.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
