About this opportunity

The Commonwealth of Kentucky, through its Finance and Administration Cabinet on behalf of the Energy and Environment Cabinet's Department of Waste Management, is issuing a Request for Bid (RFB) for the procurement of one Handheld X-Ray Fluorescence (XRF) Analyzer to support the Kentucky Brownfield Program. The primary objective is to acquire a Bruker S1 Titan 800 Premium Handheld XRF Analyzer or approved equivalent capable of conducting on-site chemical composition analysis of building and soil materials to detect lead-based paint, contaminant metals, and other potential hazardous contamination during brownfield assessments and site visits. Mandatory technical specifications include a 50kV/4W Rhodium X-ray tube, 8mm measurement spot size, graphene window silicon drift detector, automated five-position primary beam filter changer, and multilingual software interface, with additional preferred features including Bruker Instrument Tools software and Bluetooth/Wi-Fi connectivity capable of detecting elements from Magnesium to Uranium. The RFB was posted on April 7, 2025, with written vendor questions due by April 14, 2025 at 10:00 AM ET and a firm closing date of April 21, 2025 at 1:30 PM ET, with all quotations remaining valid for a minimum of 60 calendar days following the bid due date. Award will be determined on a best value basis, with 90 points allocated to price (lowest bidder receives maximum score) and 10 points allocated to delivery time in working days. All pricing must be submitted on an F.O.B. Destination Freight Prepaid and Allowed basis with delivery to the Division of Waste Management at 300 Sower Boulevard, 2nd Floor, Frankfort, Kentucky 40601. Vendors proposing alternative brands must submit descriptive literature for equality verification, and all bidders must register in Kentucky's eProcurement system (allowing 24-48 hours for account activation) and submit bids electronically only.

Kentucky resident bidders are eligible for reciprocal preference consideration, and qualified set-aside categories include Kentucky Correctional Industries, Kentucky Industries for the Blind, and qualified nonprofit agencies for individuals with severe disabilities, all of which may receive preference equal to 20 or 15 percent of maximum points respectively. Prior to contract award, vendors must provide proof of Commercial General Liability Insurance with minimum limits of $1,000,000 per occurrence and $2,000,000 aggregate, as well as Automobile Liability Insurance with $1,000,000 combined single limit coverage. All contractors must execute an Annual Affidavit for Bidders, Offerors and Contractors certifying compliance with Kentucky's campaign finance laws (KRS 45A.110 and 45A.115) and must submit required documentation including Revenue Form 10A100, Certificate of Authority if applicable, required affidavits, and EEO forms prior to award. Qualified bidders claiming nonprofit status or resident bidder status must meet specific criteria including Kentucky business authorization, one year of prior Kentucky corporate income tax filings, unemployment insurance fund payments, and active workers' compensation policies, with the procuring agency reserving the right to request supporting documentation. No specific budget range or award value is disclosed in the solicitation documents, with pricing to be determined through competitive bid evaluation.
