About this file

This is an Annual Affidavit for Bidders, Offerors and Contractors document required by the Commonwealth of Kentucky pursuant to KRS 45A.110 and 45A.115. The affidavit is effective for one year from the date of execution and must be completed by an authorized representative of any contracting party seeking to be awarded a contract or for contract renewal. The document requires notarization and submission to the Commonwealth prior to contract award. The affidavit confirms that the contractor has not knowingly violated campaign finance laws of Kentucky and that the contract award will not violate any provisions of state campaign finance laws.

The affidavit includes three attestation sections: a general campaign finance compliance certification applicable to all bidders and offerors, a qualified bidder status section for entities claiming nonprofit corporation or qualified nonprofit agency for individuals with severe disabilities status, and a resident bidder status section for entities meeting specific Kentucky residency and tax compliance requirements. Bidders claiming qualified bidder or resident bidder status must meet defined criteria including nonprofit registration, employment of individuals with severe disabilities for a minimum seventy-five percent of direct labor hours, Kentucky business authorization, one year of prior Kentucky corporate income tax filings, unemployment insurance fund payments, and active workers' compensation policies. The bidding agency reserves the right to request supporting documentation for any claimed status, and failure to provide such documentation may result in bidder disqualification or contract termination.
