About this opportunity

Texas Health and Human Services Commission (HHSC) Purchasing is soliciting bids under Invitation for Bid HHS0018137 for FY27 groceries, including prepared meals, sandwiches, snacks, yogurt, desserts, and fresh fruit, for delivery to San Antonio State Hospital, with bids due November 19, 2026 at 11:58 a.m. CST. Bidders must submit a signed Exhibit A (HHS Solicitation Affirmations, v. 2.10), the completed Exhibit C pricing sheet with no blank responses, any addendum acknowledgment forms, and the signed Warranty and Complaint Resolution Form (Exhibit 2), which requires authorization by a company officer. Omitting required documentation results in disqualification.

Products are sold by cases of six, with some items ordered in increments of ten, and shelf-life requirements run four to six days. The pricing sheet lists unit prices from $2.84 to $7.99, with a UPC assigned to each item. Delivery goes to 5900 S Presa Street, San Antonio, Texas 78223, and payment is Net 30.

The contract runs from award through August 31, 2027. Terms provide for work orders under indefinite quantity contracts, with no guarantee of volume or usage. Responses constitute a firm offer for 240 days from submission.

Affirmations require E-Verify participation, suspension and debarment verification through the Texas Comptroller and SAM, cybersecurity training for personnel with access to state systems, and artificial intelligence disclosure. They also prohibit boycotts of Israel and energy companies and discrimination against the firearm and ammunition industries, and they carry abortion-funding restrictions.

Vendors must respond to problem notifications within 72 hours and resolve related complaints within 90 days. Non-specification shipments are reimbursed or replaced in full at no cost to HHSC. Vendor-borne investigation costs include storage fees beginning the tenth day after notification, HHSC labor at $20 per hour beginning the thirtieth day, sample and shipping costs, and third-party testing at an FSIS-approved, accredited laboratory. Unresolved problems may lead to discontinued future HHSC food awards to the vendor and manufacturer.

The solicitation contact is Ja'Vorashay Johnson at 512-406-2563. The HHS Online Bid Room is optional, and its IAMOnline registration can take several days, with Help Desk support at 512-438-4720.
