About this opportunity

The Berkshire Regional Group Purchasing Program (BRGPP), acting on behalf of 32 participating municipalities in Berkshire County, Massachusetts, is soliciting bids for the FY27-09 Chip Seal cooperative purchase covering the period July 1, 2026 through June 30, 2027. This procurement seeks asphalt-rubber chip seal surface treatment services with an estimated contract value of $59,580.00, with Lee identified as a North County participant requiring 9,500 square yards of chip seal application with 10% rubber content. The services involve the application of crumb rubber polymerized asphalt (RPM) or conventional chip seal surface treatments, including material preparation, field application, quality control, and completion of work according to detailed technical specifications. Deliverables include the supply and installation of PG 58-28 or PG 64-28 asphalt binder, vulcanized ground rubber from scrap tires, and pre-heated crushed stone aggregate applied at specified rates (0.35 to 0.45 gallons per square yard for RPM treatment with 30 to 40 pounds per square yard aggregate coverage). All bidders must obtain MassDOT prequalification for Stone Sealing work prior to submission and must provide evidence of at least six successfully completed similar projects with contact information. Pricing shall be submitted as a unit cost per square yard for complete in-place work, with a fluctuating price adjustment mechanism based on variance in asphalt cement pricing from a base price of $615.00 per ton. Bid packages became available March 12, 2026, with a question submission deadline of March 27, 2026 at 4:00 p.m. and a question response deadline of March 30, 2026 at 4:00 p.m. All bids must be submitted electronically through the OpenGov procurement portal by April 2, 2026 at 1:00 p.m., with contract award anticipated by April 20, 2026. All work must comply with MassDOT 2026 Standard Specifications for Highways and Bridges and detailed specifications regarding surface preparation, weather conditions (minimum 50°F with rising temperatures, no work after September 1), material application procedures, and rolling and sweeping requirements.

All bidders are subject to Massachusetts prevailing wage rate requirements under General Laws Chapter 149, Sections 26-27F and Chapter 30, Section 39M, with mandatory compliance documentation and weekly payroll reporting required. A 5% bid deposit in the form of a certified check, cashier's check, or bid bond from a licensed surety company is required for all bids exceeding $50,000. Successful bidders must maintain comprehensive insurance coverage including $1,000,000 general liability per occurrence and $3,000,000 aggregate, and must provide a labor and materials payment bond equal to 50% of the awarded contract value upon contract execution. The winning bidder must visit the job site with the Director, retain ownership of all equipment used, and submit quarterly reports detailing goods and services purchased, remitting a quarterly administrative fee of 1.75% of reported purchases to BRGPP. Additional required submissions include tax compliance forms, non-collusion statements, debarment forms, OSHA certifications, three client references, and proof of liability insurance. The winning bidder must submit a one-year guarantee on all materials and workmanship, maintain quarterly reporting and administrative fee payments, and comply with all applicable federal, state, and local laws and regulations governing prevailing wage, safety, environmental protection, and labor standards throughout the contract term ending June 30, 2027.
