About this opportunity

The Commonwealth of Kentucky Finance and Administration Cabinet, on behalf of the Kentucky State Police, is soliciting competitive bids for the procurement of Evidential Breath Alcohol Testing Instruments (EBT) under Request for Bid (RFB) 758 2600000460. The solicitation seeks to establish a master agreement for the supply of approximately 75 units per year of CMI Intoxilyzer 800 devices or approved equivalents, with delivery to the KSP Supply Section at 94 Airport Road in Frankfort, Kentucky. The required instruments must be fully automatic, hand-held units equipped with electrochemical sensors, battery operation supporting a minimum of 500 tests at 0°C and 1,000 tests at room temperature, compact carry cases with storage capacity for 25 mouthpieces and spare batteries, and must be NHTSA-approved as evidential breath measurement devices. Bidders proposing alternate brands or specifications must submit descriptive literature to verify equivalency, with failure to provide sufficient documentation resulting in a non-responsive bid designation. The contract will be awarded using a best value evaluation method weighted at 90 points for price and 10 points for delivery time measured in working days, with the lowest bidder in each category receiving maximum points and subsequent bidders scored proportionally. Vendor questions are due by March 26, 2026 at 10:00 AM ET, and sealed bids must be submitted electronically through the Commonwealth eProcurement system by April 6, 2026 at 1:30 PM ET. The initial contract period is one year from the award date, with optional renewal for four additional two-year periods subject to written approval by all parties, and bidders must register in the Vendor Self Service System prior to submission.

Kentucky resident bidders are eligible for reciprocal preference under KRS 45A.490-494, and qualified bidders including Kentucky Correctional Industries, Kentucky Industries for the Blind, and certified nonprofit agencies for individuals with severe disabilities are eligible for preferences equal to 20 percent, 15 percent, and 15 percent of maximum points, respectively. Prior to award, successful bidders must submit proof of Commercial General Liability Insurance with minimum limits of $1,000,000 per occurrence and $2,000,000 aggregate, a Kentucky Tax Registration Application Form 10A100, and, if applicable, a Certificate of Authority for foreign entities. Bid pricing must be submitted on an F.O.B. Destination Freight Prepaid and Allowed basis with all shipping charges included, excluding federal excise taxes and Kentucky sales or use taxes, and proposed pricing must remain valid for a minimum of 60 calendar days following the bid due date. Price increases are not permitted during the first 12 months of the contract but may be requested thereafter with industry-wide justification and 30 days' notice, with late deliveries subject to a 1 percent daily deduction from invoices. All bidders must complete required affidavits attesting to compliance with Kentucky campaign finance laws, resident bidder status (if claimed), and qualified bidder status (if applicable), and the contract is subject to termination with 30 days' written notice and governed by Kentucky law. The solicitation documents do not identify an incumbent contractor or specify a total contract value; interested vendors should contact Keith Srutowski at 502-564-7007 for additional information.
