About this opportunity

The Utah Division of Purchasing issued a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for DPS DRE Software on September 8, 2026, with a due date of September 16, 2026, but has since closed the solicitation without awarding a contract under this sole-source notice. The Notice of No Award (file 6) confirms that the Division of Purchasing determined not to proceed with the Part 8 process, and any future contract award will use alternative procurement procedures.

The original scope involved a five-year non-exclusive license to the ITSMR DRE Data Entry and Management System from The Research Foundation for The State University of New York, supporting up to 150 users across the Utah Highway Patrol and certified Drug Recognition Expert officers from other law enforcement agencies statewide. The system consolidates field data capture, centralized database management, reporting and query tools, narrative-report editing, and supervisory review capabilities, with automatic upload of examination data to the federal National Highway Traffic Safety Administration tracking system to replace current manual dual-entry workflows. The system is mobile and web-based, with technical support Monday through Friday, 8 a.m.–5 p.m. Eastern Time, including routine upgrades and state-specific report configuration.

The estimated contract value was $240,000 over the initial five-year term (October 1, 2026, through September 30, 2031), with no renewal options. Year-one license fees were $45,135; subsequent annual fees escalated from $46,489 (year two) to $50,800 (year five). The licensee retains ownership of all data entered; the Foundation may use aggregated, de-identified data for research only. Utah Department of Public Safety is responsible for hardware procurement and maintenance, security compliance including Mobile Device Manager integration and lockscreen passwords, and regular software updates.

The procurement was pursued as sole-source because ITSMR was identified as the only vendor offering this product type; comparable alternatives and comparable proprietary systems developed by other states are unavailable for purchase. Vendors were permitted to challenge this sole-source determination during the public notice period by submitting evidence of competing comparable or superior products. All responding vendors must certify non-engagement in economic boycotts under Utah Code 63G-27 et seq.
