About this opportunity

The State of Utah's Division of Purchasing is seeking to award a contract for the Development of the Utah Administrative Rulemaking Management System, a specialized web-based platform focused on enhancing administrative rule filing and delay management processes. The project involves developing a comprehensive system with specific technical capabilities, including the ability to file notices of delay, link original and delayed filings, and manage complex regulatory workflows mandated by Senate Bill 268. The system must support two types of delay scenarios (partial and complete), maintain countdown clocks, create public history notes, and provide granular administrative process management with precise specifications for handling regulatory filing timelines. The procurement is being processed as a sole source (SS) type contract, with a proposed contract modification to Tecuity for further system development. The notice was posted on September 19, 2025, with a response deadline of September 26, 2025, and requires potential vendors to submit detailed documentation if they believe they can provide comparable or alternative solutions.

The contract appears to be unrestricted in terms of vendor type, but includes an Anti-Boycott Actions clause requiring vendors to certify they are not engaged in economic boycotts. The current incumbent vendor is Tecuity, and the contract is being expanded to implement new workflow requirements introduced in the 2025 legislative session. The total contract value is increasing from $763,240 to $830,640, with the current amendment adding $67,400 for system upgrades in a .NET 8 environment. The system will be developed with a focus on updating front-end and back-office visibility, adding new buttons, updating database fields, and implementing tracking for historical data. The project is scoped for completion by May of the current year, with an emphasis on creating a more efficient digital platform for administrative rulemaking. Vendors must also comply with the Government Records Access and Management Act (GRAMA) requirements, including submitting both redacted and non-redacted versions of their proposals.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
