About this opportunity

This is a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process issued by the Utah Department of Workforce Services through the State Division of Purchasing and General Services for Amendment 1 to Contract 236343. The procurement concerns continued support and maintenance services for the Debt Manager system, a specialized software solution used to track, collect, and maintain data on benefit overpayments and collections due to negligence or fraud at both state and federal levels. The contract represents a renewal utilizing allowed one-year renewal options from the original solicitation MW23-43. The sole-source justification indicates that C&R Software (Jonas Collections and Recovery Inc.) is the only source capable of supporting and maintaining the proprietary Debt Manager product, making this a non-competitive award. The estimated contract value for this amendment is $135,573.64, representing a 36 percent increase from the original contract total of $379,050.00 to a proposed total of $514,623.64, with the increase attributed to contract term extension and an updated quote for services from the vendor. The publication period for this Notice of Intent runs from March 10, 2026, through March 17, 2026, during which interested and qualified vendors may contest the sole-source determination by submitting documentation demonstrating competing sources exist or that their firm can provide comparable or superior products meeting or exceeding specifications. No site visits, bidders' conferences, or specific response dates beyond the challenge period are identified in this notice.

All responding vendors must comply with Utah Code 63G-27 et seq., certifying they are not engaged in economic boycotts or boycotts of the State of Israel and agreeing not to engage in such boycotts during the contract term. The incumbent vendor is C&R Software (Jonas Collections and Recovery Inc.), which has been providing the Debt Manager system support and will continue to do so under this amendment. The existing Debt Manager infrastructure is a proprietary system, and the amendment requires integration with this established technology platform. Vendors seeking to protect trade secrets and commercial financial information may submit a Business Confidentiality Claim form under the Government Records Access and Management Act (GRAMA) and Utah Code sections 63G-2-305 and 63G-2-309, requiring submission of both redacted and non-redacted versions of proposals. The contract value for Amendment 1 is $135,573.64, with the total amended contract value reaching $514,623.64, and freight costs are listed as $0.00. If valid challenges are received demonstrating other qualified vendors exist for sole-source awards, the Division of Purchasing will not award the contract without competition; however, the state may appropriate additional funding through legislative action if provided for purposes identified in the scope of work.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
