About this opportunity
The Utah Department of Health and Human Services is seeking to amend existing Contract 236076 with Bio-Rad Laboratories without engaging in standard procurement, with a notice-and-challenge period closing June 10, 2026. This is a sole-source amendment justified under Utah Procurement Code Section C (Impracticality) based on Bio-Rad's proprietary Digital PCR System equipment, specialized consumables, and patented software integrations that are specific to the incumbent vendor.
The amendment adds funding for one-year service coverage on two existing instruments—a QX600 AutoDG Droplet Digital PCR System and QX600 Droplet Reader—and increases reagent funding through the contract term ending August 31, 2027. The service agreement provides unlimited on-site repair services including travel, parts, and labor, with one preventive maintenance visit included. Service coverage runs from December 18, 2026, through August 31, 2027, extending the current expiration of December 17, 2026.
The amendment value is $955,000. The original contract value was $80,000; the current total is $954,060; the amended total will be $1.909 million, representing a 2,386.3 percent increase from the original contract. Bio-Rad's current quotation for equipment and service is $14,428 (reflecting a $7,214 discount from list price of $21,642), with prepaid shipping added to the invoice. The amendment is driven by increased measles testing requirements.
Vendors may challenge this non-competitive award by submitting documentation of comparable or competing products, proof of capability to provide equivalent services, and cost comparisons, along with certification of compliance with Utah Code 63G-27 et seq. regarding economic boycotts and boycotts of Israel. If no valid challenges are received, the Division of Purchasing may proceed with the amendment to Bio-Rad without further competition.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
