About this opportunity
The State of Utah, through its Division of Purchasing, is issuing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for Contract 226286 Amendment 4, which involves a funds increase to an existing contract. This non-competitive procurement is being pursued under Utah Procurement Code provisions that permit single-source awards when only one source exists for the procurement item, when transitional costs are significant, or when circumstances make standard procurement processes impractical and contrary to the procurement unit's best interests. The specific goods or services, deliverables, key objectives, required qualifications, evaluation criteria, and detailed contract terms are contained in supporting documentation submitted by the Conducting Procurement Unit but are not detailed in the public notice itself. The opportunity was posted on March 26, 2026, with a deadline of April 2, 2026, which represents the public challenge period during which interested and qualified vendors may contest the sole-source determination by submitting documentation of competing sources, comparable or superior capabilities, and cost comparisons if applicable.
The procurement includes restrictions requiring vendor compliance with Utah's anti-boycott legislation, specifically prohibiting engagement in economic boycotts or boycotts of the State of Israel during contract performance. Vendors submitting proposals may claim business confidentiality protections under Utah Code 63G-2-305 and 63G-2-309 through submission of a Claim of Business Confidentiality form, requiring concurrent submission of both redacted and non-redacted proposal versions to protect trade secrets or commercial financial information. The notice does not identify an incumbent vendor or current contractor by name, though the amendment structure indicates continuation of an existing contract relationship. No specific budget range or award value is provided in the public notice; however, the amendment references a funds increase to the existing contract, with the legislature reserving the right to add additional funding if appropriations are provided for the identified scope of work. Qualifying vendors may challenge the non-competitive procurement determination during the public challenge period if they can demonstrate competing capabilities and competitive cost structures.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
