About this file

This document is a GRAMA Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman for use in state procurement processes. The form is designed to allow vendors and contractors submitting proposals to the Division of Purchasing to claim trade secret or commercial financial information protections under Utah Code 63G-2-305 and 63G-2-309. Claimants must submit both redacted and non-redacted versions of their proposals, with the entire proposal unable to be fully redacted. The form requires detailed claimant information including company name, address, contact details, and a concise written statement explaining the confidentiality claim basis. Specific details must be provided identifying which pages and paragraphs of the submitted materials require protection, along with the justification for each confidentiality request.

The form serves as a procedural requirement for Utah state and local contract opportunities and does not guarantee that claimed information will receive protected classification if the government receives a public records request. Vendors and contractors submitting proposals must complete this form contemporaneously with their proposal submissions to establish a valid confidentiality claim. The Division of Purchasing will not perform redactions on behalf of claimants who fail to provide properly redacted proposal copies. This document is directly referenced in Contract 226286 Amendment 4 and applies to the notice of intent to award without standard competitive procurement.

Office of the Government Records Ombudsman Utah State Archives

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
