About this opportunity

This is a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process issued by the Utah Department of Government Operations, Division of Purchasing and General Services, on behalf of the Department of Workforce Services (DWS) Unemployment Insurance Division. The procurement involves a funds increase and extension amendment (Amendment 4) to Contract 216120 with LexisNexis for fraud detection services. The contract extension will prolong the existing agreement from its current expiration date of January 31, 2025, to March 31, 2025, adding an additional 60 days to allow the Division of Purchasing to complete negotiations on a new state cooperative contract with LexisNexis. The fraud detection services are critical to DWS's Unemployment Insurance Division operations, and the extension is designed to prevent service disruption in these essential fraud prevention operations while negotiations for the replacement cooperative contract continue. The anticipated new cooperative contract start date is April 1, 2026, though final terms and conditions with LexisNexis remain under negotiation. The state has established a due date of January 26, 2026, for interested vendors to submit challenges to the non-competitive award determination. Under Utah Procurement Code provisions, vendors may contest the sole source determination by submitting documentation demonstrating that competing sources exist for the procurement item or that they can provide comparable or superior products meeting or exceeding specifications.

The original contract total was $395,000, with the current contract total at $432,500, and the proposed increase will bring the total contract amount to $443,800, representing a 12.35 percent increase from the original contract value. LexisNexis is the incumbent contractor and sole source provider of fraud detection information services to DWS's Unemployment Insurance Division, which serves as the justification for the non-competitive award. The increase reflects the extended service period and potential price or rate adjustments necessary to maintain continuity of critical fraud prevention operations. Any vendor submitting a challenge to the sole source determination must certify compliance with Utah Code 63G-27 et seq., including certification that they are not engaged in economic boycotts or boycotts of the State of Israel and will not engage in such boycotts during contract performance. The state reserves the right to reject the non-competitive award if valid challenges are received during the public notice period, unless the award is justified by transitional costs or impracticability. The procurement is classified as a sole source award under the ACWESPP (American Cooperative Work for Essential Sole Source Procurement Program) solicitation type, and as the proposed total exceeds $50,000, public notice is required for this contract increase.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
