About this opportunity

The Davis School District (DSD) Purchasing Department is seeking to procure online English language learning licenses from Burlington English for its Adult Education program, specifically targeting ESOL (English for Speakers of Other Languages) students. The procurement involves 200 online licenses at $96 each, totaling $19,200, with potential expansion based on enrollment. The curriculum encompasses comprehensive online English language courses ranging from basic to advanced levels, including digital literacy modules, career exploration resources, and lesson materials aligned with CASAS testing standards. The district intends to award the contract without standard competitive bidding, invoking the "only one source" provision under the Utah Procurement Code. The solicitation is specifically for a five-year term, with a Notice of Intent to Award published on May 9, 2025, and responses due by May 16, 2025. Interested vendors must submit detailed documentation demonstrating comparable or alternative procurement capabilities, including vendor name, challenge explanation, and potential cost comparisons. The procurement is unique in that Burlington English offers a curriculum with extensive features not found in alternative online programs, particularly in supporting lower-level English speakers with comprehensive lesson plans and real-life scenarios.

The procurement does not explicitly outline specific set-aside designations or restrictions on responding organizations. The contract is governed by Davis School District's standard terms and conditions, which require vendors to carry insurance with policy limits of $1,000,000 per incident and $3,000,000 in aggregate, and comply with various state and federal regulations. Vendors must provide proof of insurance and add Davis School District as an additional insured. The contract terms include provisions for anti-discrimination compliance, procurement ethics, and employment verification. While no specific disadvantaged enterprise requirements are mentioned, the standard terms prohibit economic boycotts and require contractors to certify they are not engaged in boycotts of the State of Israel. The potential contract value is $19,200 for the initial 200 licenses, with flexibility for additional licenses based on program enrollment. The procurement appears to be a sole-source procurement, with Burlington English being the preferred vendor due to the unique comprehensiveness of their online English language learning curriculum.
