Contractor must maintain comprehensive insurance including workers' compensation, general liability of $1 million, cyber liability of $5 million to $10 million depending on records held, professional liability of $1 million, and crime insurance of $1 million. Contractor must implement background checks for all employees and agents with access to state records and is prohibited from offshore data processing and federal tax information access from outside the United States. Quarterly reporting is required for contracts exceeding three months, due within five business days following each calendar quarter end.
The contract includes mandatory AI Disclosure and Use Requirements (Appendix E): prior to delivery, the contractor must disclose in writing whether and how AI tools were used in creating deliverables, identify specific AI tools employed, and ensure all deliverables are reviewed and verified by qualified personnel. Confidential state data, personally identifiable information, and non-public information are prohibited from input into public or consumer-grade AI systems.
Proposals must remain binding for 180 calendar days. All proposed pricing must remain firm throughout the full contract term and include all applicable fees. Proposals are submitted through bidnetdirect.com. A virtual public proposal opening will be held; details appear in the Schedule of Activities within the full RFP.
