About this opportunity

The Utah Division of Purchasing has issued a notice of intent to award a contract for a Building Code Cross Reference Library through a non-standard procurement process. The procurement involves acquiring a specialized library or system, with MADCAD appearing to be the sole source vendor. The contract opportunity was posted on August 7, 2025, with a proposal due date of August 14, 2025. The procurement is being pursued under specific exemptions in the Utah Procurement Code, which allow for direct award when only one source exists or when standard procurement processes would be impractical. Based on the attached documentation, the primary objective seems to be establishing a comprehensive building code reference system that provides cross-referencing capabilities for regulatory compliance. The procurement unit has submitted documentation justifying the direct award, claiming unique circumstances that necessitate bypassing typical competitive bidding procedures.

The procurement appears to be restricted to a single vendor, with no indication of set-aside designations for disadvantaged enterprises or alternative bidders. The attached documents suggest MADCAD is the intended contractor, with a scope of work that implies a specialized technology solution for building code information management. While specific budget details are not explicitly stated in the provided documents, the procurement seems focused on acquiring a unique technology platform rather than a standard commodity purchase. The contract appears to be a direct procurement without competitive bidding, based on the vendor's unique capabilities or technological specificity. The procurement is being conducted by the Utah Division of Purchasing, with the expectation of a streamlined award process that circumvents traditional competitive procurement methods.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
