About this opportunity
The Utah Division of Purchasing is issuing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for GAMS Software (ReEDS / GAMS, BD26-81) with a due date for challenges of June 17, 2026. The award is justified as sole source on the basis that GAMS Software is uniquely designed to work exclusively with the National Renewable Energy Laboratory's ReEDS modeling system and cannot be reasonably modified to allow for competition.
The conducting unit is the Utah Department of Government Operations, Office of Energy Development. GAMS Development Corp. is the identified vendor. The software is required to analyze ReEDS output and functions as an integral component of NREL's capacity expansion model for the power sector. The software license is configured as a user-based, floating user license with a network maximum of 26 cores and includes GAMS/Base Module and GAMS/CPLEX Module, with maintenance and support services through the contract term.
The estimated contract value is $32,000 for a one-year initial term with four optional renewal years, for a potential total of five years. Future renewal costs are projected at $7,820 annually for 2028–2029, 2029–2030, and 2030–2031. The NREL Contract Number is 256035; the DTS TAA Approval Number is RITM0275806.
No market research was required; no similar vendors were contacted, and no existing state cooperative contracts provide comparable alternatives. The Division of Purchasing will determine whether other interested and qualified vendors exist before finalizing the award. Vendors challenging the sole source determination must submit detailed documentation demonstrating competing sources and their ability to meet or exceed specified requirements. All vendors must certify compliance with Utah Code 63G-27 et seq., prohibiting economic boycotts and boycotts of the State of Israel. Vendors may submit confidentiality claims for trade secrets and commercial financial information under GRAMA.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
