About this opportunity

The West Virginia Department of Environmental Protection is soliciting quotes under ARFQ 0313 DEP2700000030 for construction and reclamation of the Simpson Creek Highwall, Tipple and Portals Phase II abandoned mine land project in Barbour County, with a mandatory pre-bid meeting on November 5, 2026 at 10:00 a.m. Eastern. Failure to attend the pre-bid disqualifies a bidder. Bids are due November 23, 2026 at 10:30 a.m. Eastern through wvOASIS.

Vendors must comply with a West Virginia local labor market requirement that 75% of employees come from the local labor market on public improvement construction, and Davis-Bacon wage rates apply because the work is federally funded. Each contractor must hold a West Virginia contractor's license before award and submit an Abandoned Mine Lands Contractor Information Form to the Office of Surface Mining Reclamation and Enforcement for eligibility verification under 30 CFR 874.16.

The 53-line-item scope covers mobilization and demobilization (capped at 10% of total bid), site preparation, excavation of 58,104 cubic yards, gravel drive rehabilitation (2,000 tons), temporary access roads (1,800 tons), erosion control and revegetation (18 acres), vegetated and riprap channels, 18-inch and 24-inch HDPE culverts, 518 linear feet of 12-inch mine seal conveyance pipe, pavement resurfacing (48 tons), and traffic control. Item 12.0, Utilities, is a no-bid item. Pricing is lump sum or unit price by line item and firm for the contract life unless otherwise specified. Federal funds compliance covers Build America, Buy America, 2 CFR 200.317–200.327, and the prohibition on covered telecommunications equipment.

The term is one calendar year with up to three one-year renewals by mutual written consent of the Agency, Vendor, and Attorney General approval. Bid bonds equal 5% of the total bid, performance and labor/material payment bonds each equal 100% of contract value, and commercial general liability and automobile liability insurance must carry limits of not less than $2 million per occurrence. A Disclosure of Interested Parties form is required if the contract value equals or exceeds $1 million. Other disqualifiers include federal or state debarment, outstanding environmental enforcement actions, unresolved vendor complaints, and omission of the Addendum Acknowledgement.

Addendum No. 1 revised the pre-bid directions, which place the meeting at the project site east of WV-76 near Polk Drive. Technical questions are due November 13, 2026 at 4:00 p.m. Eastern to buyer Larry T. Workman at larry.t.workman@wv.gov. Cost is the primary selection criterion, according to a solicitation file summary.
