About this opportunity
The West Virginia Department of Environmental Protection (WVDEP), Office of Abandoned Mine Lands and Reclamation (AML), is soliciting bids for an open-end contract to establish jetter and vacuum truck services in Northern Region 2, which encompasses Grant, Hampshire, Hardy, Mineral, Monongalia, Pendleton, Preston, Randolph, and Tucker counties. This is a state-level procurement structured as an Agency Master Agreement with an estimated contract value not to exceed $500,000 for one calendar year with options for renewal up to three successive one-year periods. The solicitation seeks comprehensive equipment, labor, materials, and services for previously reclaimed AML projects in the Fairmont region, including mobilization and demobilization services (10,000 miles estimated), compact excavators with specialty attachments (25 hours), 4x4 utility task vehicles (100 hours), sewer cleaning jetter trucks with 55 GPM at 2,000 PSI capacity and 1,000-gallon minimum tank (750 hours), vacuum trucks with minimum three cubic-yard capacity (50 hours), one-ton 4x4 trucks with crane and equipment (25 hours), and various materials including pelletized limestone (600 lbs), fertilizer (1,000 lbs), permanent seed mixture (1 acre), straw mulch, animal guards, soda ash briquettes, and laborer services (1,500 hours). All equipment hourly rates must include operator costs, fuel, and maintenance, with materials priced per pound or per unit as delivered to site unless otherwise noted. Vendors must demonstrate capability to supply specified equipment, labor, facilities, and materials for multiple concurrent or consecutive projects as directed by WVDEP-AML, with all equipment maintained in good operable condition and compliant with federal and state safety regulations. A mandatory pre-bid meeting was held on July 16, 2025, at 10:00 a.m. at the WV DEP Fairmont Office (1000 Technology Drive, Suite 3220, Fairmont, WV 26554), attendance at which was required for bid submission; written questions were due by July 23, 2025, submitted to DEPProcurement@wv.gov; and bids closed on July 30, 2025, at 10:30 a.m. through electronic submission via wvOASIS Vendor Self Service portal.
Bidders must meet several critical requirements and comply with applicable regulations to be considered for award. The successful vendor must furnish a valid bid bond of 5 percent of the total bid amount, a performance bond of 100 percent of contract value, and a labor/material payment bond of 100 percent of contract value prior to contract award; maintain Commercial General Liability and Automobile Liability Insurance with limits not less than $2,000,000 for bodily injury and property damage per occurrence; and complete the AML Contractor Information Form (AVS) for eligibility evaluation from the Office of Surface Mining Reclamation and Enforcement (OSMRE) under 30 CFR 874.16. The procurement incorporates Davis-Bacon wage rate requirements if federally funded, requires compliance with drug-free workplace affidavits and policies, includes local labor market hiring requirements, and mandates domestic steel and aluminum product preferences and Build America Buy America Act compliance. Federal requirements applicable to non-federal entity contracts under 2 C.F.R. 200.317-200.327 include provisions for minority and women-owned business enterprise participation, equal employment opportunity, anti-kickback protections, Clean Air Act and Federal Water Pollution Control Act compliance for contracts exceeding $150,000, debarment and suspension verification through SAM, and Byrd Anti-Lobbying Amendment certification for awards exceeding $100,000. No incumbent vendors or current contractors are identified in the solicitation documents. The contract pricing is firm for the life of the contract unless otherwise specified, with payments made in arrears upon receipt of proper invoices; the vendor must accept payment by electronic funds transfer and P-Card, and liquidated damages of $1,000 per working day may be assessed for failure to substantially complete project work within specified contract time, except for approved extensions or winter shutdown periods.
