About this opportunity
The Utah Department of Health and Human Services is seeking to award an amendment to Contract 246221 with Life Technologies without competitive procurement, with a notice-and-challenge period ending September 10, 2026. The amendment adds $58,556.96 in funding to extend two-year service coverage for two Q5 instruments beyond their warranty period, increasing the original contract total from $120,824.38 to $179,381.34.
The procurement unit is pursuing a sole-source or non-competitive award under Utah Procurement Code provisions, claiming either that Life Technologies is the only available source, that transitional costs make competition impractical, or that circumstances otherwise favor non-competitive award. The specific justification is contained in supporting documentation filed with the Division of Purchasing and General Services. The original contract was conducted under solicitation BH24-32 for Custom Toxbox Analytical Plates; Life Technologies is the incumbent.
Interested vendors may challenge the sole-source determination by submitting evidence demonstrating the existence of competing sources or comparable products meeting or exceeding specifications, along with cost comparisons if applicable. All challenges must be submitted to the Division of Purchasing by September 10, 2026; direct contact with the Conducting Procurement Unit is not permitted. Any vendor submitting a challenge must certify compliance with Utah Code 63G-27 et seq., confirming non-participation in economic boycotts or boycotts of the State of Israel and commitment to refrain from such boycotts during any contract term.
If no valid challenges are received, the Division of Purchasing may award the amendment to Life Technologies without further competition. The statement of work and detailed performance requirements are provided in redacted form; vendors seeking complete specifications should review all attached documentation in the procurement record.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
